PERSONAL LEAVE/SICK LEAVE. 13.1 Personal leave is paid time off granted to an employee for purposes of taking planned annual leave, dealing with personal business, recovering from illness or injury, and care and attend to a member of his/her family, or a dependent minor and who is afflicted with a serious illness or injury and only when no other person is available to care for said dependent(s), or the hospitalization of such family members, without loss of pay or benefits. Personal leave shall begin to accrue from the first (1st) full week of employment.
13.2 Bargaining unit employees working a regular schedule of at least 40 hours a week shall earn and accrue annual personal leave in accordance with following formula:
A. From the employee’s date of hire or adjusted date of hire up to the employee’s fourth (4th) anniversary 2.62 hours per week (one hundred thirty-six (136) hours per year).
B. From the fourth (4th) anniversary up to the ninth (9th) anniversary, 2.93 hours per week (one hundred fifty-two (152) hours per year).
C. From the ninth (9th) anniversary up to the fifteenth (15th) anniversary 3.39 hours per week (one hundred seventy-six (176) hours per year).
D. From the fifteenth (15th) anniversary up to the twenty-fourth (24th) anniversary
PERSONAL LEAVE/SICK LEAVE. After six months of employment and on each 12-month anniversary thereafter, the employee shall be entitled to sick leave:
PERSONAL LEAVE/SICK LEAVE. 7.3.1 Every weekly paid Employee who is unable to attend or remain working at their place of employment by reason of illness which complies with the conditions prescribed in paragraph 7.3.2 hereof shall be granted by the Employer paid leave not exceeding the sick leave credit of that Employee computed in accordance with this Clause.
7.3.2 That said leave shall be granted and the Employee shall be entitled to pay in respect thereof on compliance with the following conditions:
7.3.2.1 An Employee shall, except where it is impractical to do so through circumstances beyond the Employee's control, within 2 hours of normal commencement of duty inform the Employer of the inability to attend for duty and where practicable the estimated duration of the absence; and
7.3.2.2 An Employee shall not be required to produce a medical certificate for sick leave, when such sick leave is only for one day duration. Periods of two days or more will require production of a medical certificate from a registered health practitioner or alternative proof of illness, eg a statutory declaration in writing. Notwithstanding the provisions above, if so required by the Employer, with prior notice, the Employee shall produce to the Employer, a medical certificate from a registered health practitioner or other reasonable evidence to prove that the Employee was unable to attend for duty on the day or days in respect of which the sick leave is claimed.
7.3.3 For the purposes of this Clause the word "illness" includes personal injury, but does not include any injury for which compensation is payable under the Worker's Rehabilitation and Compensation Act, 1986, as amended.
7.3.4 In the first year of service with the Employer a full time Employee (other than a Casual Employee) shall be entitled to a grant of leave by the Employer on the Employee's normal rate of pay under this Clause on the basis of 1 and 7/13 hours for each week of service and in the succeeding years of continuous service with the Employer. Such an Employee shall, on or after the commencement of each such year, be entitled to a grant of leave under this Clause by that Employer equal to ten days on the Employee's normal rate of pay under this Agreement.
7.3.5 The sick leave provided for by this Clause shall accumulate during each year of an Employee's service. Any balance of the period of such leave which has in any year not been utilised by an Employee as paid sick leave may be claimed by such Employee in a subsequent year wit...
PERSONAL LEAVE/SICK LEAVE. The Chief Financial Officer shall have up to three days annual non-accumulative personal leave as approved by the Superintendent, and 15 days annual sick leave, which may be accumulated, to 270 days. However, should the Chief Financial Officer reach the maximum of 270 days, a separate calculation of additional days is permitted to accumulate for transfer to another district if applicable. All unused and accumulated personal days will be transferred to Chief Financial Officer’s sick leave balances at the end of each school year. Absences and leaves of absences will be governed by the district’s adopted rules for certified/licensed or non-certified/licensed staff.
PERSONAL LEAVE/SICK LEAVE a) It is unlawful for the employer to pay sick leave entitlements for any period during which an employee receives workers compensation payments.
b) Employees must notify the employer by telephone or arrange for the employer to be notified before the commencement time of work for that day of their inability to attend for work, the nature of their illness or injury and the estimated length of their absence.
c) Employees will be required to provide a medical certificate as proof of personal illness or injury after the first day off on sick leave.
d) The employer may require an employee to provide a medical certificate as proof of personal injury or illness for any sick leave absences on the day before or the day after a weekend or public holiday or an RDO
e) Payment of sick leave may be withheld if an employee fails to provide a medical certificate.
PERSONAL LEAVE/SICK LEAVE. 30.1. An employee on weekly hiring who is absent from his/her work on account of personal illness, or on account of injury by accident arising out of and in the course of his/her employment shall be entitled to leave of absence without deduction of pay, subject to the following conditions and limitations:
30.1.1. An employee shall not be entitled to paid leave of absence for any period in respect of which he/she is entitled to WorkCover.
30.1.2. An employee shall, within 24 hours of the commencement of such absence, inform the company of his/her inability or illness and the estimated duration of the absence. Provided that it shall not be considered to be a breach of this clause if an employee who fails to give notice as provided hereof proves to the satisfaction of his/her employer that his/her
30.1.3. An employee shall produce or forward, within 48 hours of the commencement of such absence, a medical certificate issued by a registered health practitioner. Where it is not reasonably practical to provide a medical certificate, a Statutory Declaration stating nature of absence will be acceptable.
PERSONAL LEAVE/SICK LEAVE. (a) A full time employee is entitled to claim up to 10 days paid personal leave, for each year of continuous service, for absences due to personal illness or injury.
(b) Part time employees and part year employees are entitled to personal leave on a pro-rata basis to that of a full time employee.
(c) Personal/xxxxx’s leave accrues on a weekly basis and is cumulative.
(d) A medical certificate must support an application for personal leave for absences from work exceeding two days if reasonably practicable but if not reasonably practicable a statutory declaration in relation to the absence is required.
(e) Where an employee is ill or injured for 7 consecutive days or more during a period of annual leave and provides a medical certificate to the employer, the employer will grant personal leave for the period of sickness or injury and reinstate the equivalent amount of annual leave.
(f) If an employee has a worker’s compensation claim approved, any personal leave taken in relation to the approved claim will be reinstated to the employee.
(g) On termination of employment, unused personal leave is not paid out.
(h) The provisions of this clause do not apply to casual employees.

PERSONAL LEAVE/SICK LEAVE. 14.1 Generally, employees will be entitled to 10 days sick leave per annum. Unused sick leave will accumulate from year to year.
14.2 Sick leave will be discharged on the basis of a 7 day per week, i.e. when rostered to duty on weekends and being unable to attend due to sickness, the day/days will be recorded as sick leave.
14.3 A Sick Leave Certificate will be supplied, where practicable, in respect of any day on which it is necessary to replace an employee in order to perform Marine Services. Sick leave taken when on approved uninterruptible leave will be re-credited upon provision of a medical certificate.
14.4 An employee may transfer all or part of his/her accumulated sick leave entitlement to another employee, who at that time is on sick leave and has exhausted his/her own entitlement, provided both are permanently employed, and remain as such, by North Western Shipping & Towage. The employees must request such transfer of entitlement in writing and give written acknowledgement that they agree with the corresponding adjustment of their sick leave balance.
14.5 Subject to satisfactory proof and notice being provided to the Company, an employee who requires time away from employment when rostered on in order to care for a member of their immediate family or household who requires care because of a personal injury or illness or support because of an unexpected emergency is entitled to use normal sick leave. A maximum of ten (10) days per annum may be used for this purpose.
14.6 An employee’s immediate family is as defined in the Workplace Relations Act 1996 and includes the employee’s spouse and a child, parent, grandparent, grandchild or sibling of the employee or the employee’s spouse
14.7 Subject to satisfactory proof and notice being provided to the Company, an employee may be entitled to take 2 days of unpaid carer’s leave to care for or support a member of the employee’s immediate family or household who requires care or support if the employee does not have an accrued entitlement to any other paid personal sick and carer’s leave or other such similar leave.
14.8 In the case of a family member suffering a long term or serious illness, an employee may, with the consent of the employer, take unpaid leave without penalty for the purpose of providing care for that person.
PERSONAL LEAVE/SICK LEAVE. 35.1 Employees are entitled to accrue 76 hours of leave per annum (pro-rata for Part-Time and job share Employees).
35.2 Employees’ credits will accrue and will be paid at the Employee’s base pay.
35.3 Employees will call and discuss with their immediate Supervisor/Manager by 4:00pm the day prior to their sick leave absence. Making this call by 4:00pm will assist their immediate Supervisor/Manager to arrange replacement staff to meet operational requirements.
35.4 In the event that the Employee cannot meet the requirement by 4:00pm, they will call their immediate Supervisor/ Manager and discuss as soon as possible. Wherever possible the Employee should endeavour to call no later than the Employee’s ordinary starting time on the first day subject to the provisions in clause 35.8 below.
35.5 Where a pattern of sick leave is identified, the Employer will advise the Employee and the Union of the pattern.
35.6 Following this discussion, the Employer can require a medical certificate for each sick leave absence paid or unpaid.
35.7 Where a pattern has been identified and subclause 35.6 above applies, a further review of this requirement will be undertaken six (6) months following the discussion with the Employee.
35.8 The Employee will, unless it is not reasonably practicable so to do (proof will be on the Employee), before the Employee’s ordinary starting time on the first day of the Employee’s inability to attend for duty and, as far as practicable, state the nature of the illness or injury and the estimated duration of the absence.
35.9 Subject to clause 35.10 below the Employee will furnish to the Employer such evidence as the Employer may reasonably desire that the Employee was unable, by reason of such illness or injury, to attend for duty on the day or days for which sick leave is claimed.
35.10 The Employee will have not more than four (4) days absences due to sickness or injury in any one (1) sick leave year without presenting a medical or dental certificate to the Employer, but if the single day absence occurs before or after a public holiday or a rostered day off the Employee must furnish to the Employer such evidence as the Employer may reasonably desire that the Employee was unable, by reason of such illness or injury, to attend for duty on the day or days for which sick leave is claimed.
35.11 If a holiday as defined in this Agreement or gazetted occurs during an Employee’s absence on sick leave, then such holiday will not be counted as sick leave....
