Sick Leave Donation Plan. A. If a bargaining unit member exhausts his/her sick leave accumulation due to catastrophic illness or injury, another bargaining unit member may voluntarily donate up to ten (10) days (equivalent to hours worked per day) of his/her accumulated sick leave to the absent member only if the donating member has a balance of accumulated sick leave of at least twenty (20) days (equivalent to hours worked per day). B. To apply for the Sick Leave Donation Plan, the bargaining unit member must submit a doctor’s statement certifying that the member is unable to work due to personal illness or injury at least ten (10) workdays (equivalent to hours worked per day) prior to the need of the absent member. The application will be referred to the Superintendent and OAPSE President for approval or denial. First consideration shall be given to those employees who have donated sick leave. C. The bargaining unit member may use donated sick leave only after having exhausted all personal and sick leave. The first donations will be used to repay any advanced sick leave. D. Donated sick leave may not be used for severance pay. E. A catastrophic illness or injury is one that is medically serious, and/or incapacitates the member or his/her immediate family members, and which creates financial hardship because the member has exhausted all eligible leave accruals. This may include pregnancy complications that are medically serious and/or incapacitates the member. However, sick leave donations shall not be requested by a member for routine maternity leave.

Sick Leave Donation Plan. A. The Board and the Association hereby agree to establish a sick leave donation plan. This plan’s purpose is to allow all employees the ability to donate their sick days to another employee for the purpose of a catastrophic illness. B. Employees may apply for donated sick leave days upon complete exhaustion of their accumulated sick leave days. Employees desiring to use the sick leave donation plan should contact the Association president. The Association president will notify the superintendent and make arrangements to implement the plan. C. Employees wishing to donate a sick day will use the form provided in Appendix F.
Sick Leave Donation Plan. 23.1 A unit member may donate two (2) days worth of assigned hours of sick and/or vacation leave per year, subject to the terms and provision of this Section. The donation shall be irrevocable. Sick leave which is donated under this Section shall be deducted from the accrued sick leave authorized under Section 23.1.2. 23.2 An employee of the unit may donate two (2) days worth of assigned hours of sick and/or vacation leave annually to the catastrophic leave bank described below. Only an employee who, as a result of a catastrophic illness or injury, as defined below, has exhausted all paid personal injury and illness leave entitlement, may draw from the leave bank. No leave may be drawn from the leave bank for an injury or illness which arises out of employment. 23.3 A catastrophic leave bank shall be established to which employees may donate leave, as provided herein. The total leave donated to the bank by all employees in any school year shall not exceed two hundred days. Leave in the bank shall accumulate from year to year, provided that no additional leave may be donated by any employee unless the balance in the leave bank is less than two hundred days. Leave shall be drawn at the rate equal to assigned hours. Only employees who have elected to participate in the leave donation at the beginning of each school year shall be eligible to draw from the bank in that school year. Eligible employees who have elected to participate may draw up to a total of no more than 30 days of their regular assigned hours. 23.4 A catastrophic injury or illness shall be defined as any injury or illness which for a period of not less than ninety (90) consecutive days, has caused an employee to be incapacitated from the performance of duty as an employee of the District, or is reasonably certain to result in such incapacity for not less than (90) ninety consecutive days, based upon competent medical evidence. Catastrophic injury or illness shall also include an illness or injury that incapacitates a member of the employee's family, which incapacity requires the employee to take time off work for a period of not less than ninety (90) consecutive days, and taking an extended time off work creates a financial hardship for the employee. 23.5 An employee who himself is suffering from a catastrophic injury or illness may not draw upon the leave bank until exhaustion of all paid illness or injury leave. Sick Leave Donation Plan. The School Board and Western Education Association/IEA/NEA herby agree to the following sick leave donation plan. The plan’s purpose is to allow any District employee, including non-union employees, the ability to donate their sick days to another employee who has suffered a catastrophic event, serious illness or injury. It is not the purpose of this plan to provide additional days to staff who have exhausted their accumulated sick leave and are applying for additional sick days. Days are donated to the Sick Leave Bank and not to individual recipients selected by the employee. Donated days are immediately deducted from the employee’s accumulated sick leave. They are housed in the bank until an approved Sick Leave is granted.
Sick Leave Donation Plan. An MBU who has exhausted all of his/her sick leave per Section 8.1 due to a catastrophic illness or injury to the member or to his/her immediate family can request sick leave donations of up to no more than sixty (60) days in a school year, from other MBUs by contacting the FPEA President. A catastrophic illness or injury is one that is medically serious, and/or incapacitates the MBU or his/her immediate family members, and which creates financial hardship because the MBU has exhausted all eligible leave accruals. This may include pregnancy complications that are medically serious and/or incapacitate the MBU. However, sick leave donations shall not be requested by an MBU for routine maternity leave. The FPEA President or designee shall forward this request to the membership through written and/or electronic communication. The FPEA President or designee will notify the Superintendent or designee that such a request has been made. MBUs shall have the option of donating up to five (5) sick leave days in any one school year to the MBU making the request. Any unused donated days will return to the donating MBU on a first-donated, first-used basis. This donation will be made by completing a sick leave donation form to be forwarded to the Treasurer’s office. Upon receipt of the leave donation form, the Treasurer’s Office will forward a copy of the processed form to both parties of the FPEA. The parties may choose to extend the sixty (60) day limit by mutual agreement.

Persons desiring to use the sick leave donation plan should contact the Association president of their respective union. The Association president and the Superintendent shall make arrangements to convene the sick bank committee to determine if the request qualifies for the sick bank donation plan. District personnel wishing to donate days will use the form provided by the board of education office. A committee will be established to act as the governing body for the administration of the Sick Leave Donation Plan. The committee shall consist of one (1) member from each bargaining unit and one (1) person named by the superintendent. The following are minimal criteria for use of sick day leaves:  Must have a catastrophic event, serious illness or injury.  Must have doctor’s statement.  The employee is not required to exhaust his/her accumulated sick leave or anticipated leave of absence prior to using days from the sick leave donation plan.  Must give the Sick Leave Donation Committee a written request for the estimated number of days required. Beginning with the third consecutive day of absence, an employee may be eligible to use the Plan. If the employee is eligible, the Plan coverage shall be retroactive to include the first day of absence for coverage. The consecutive day rule does not apply to dialysis, cancer treatment, and other intermittent absences due to life threatening occurrences.
Sick Leave Donation Plan. In the event that a catastrophic illness or injury of a bargaining unit member results in the exhaustion of his/her sick leave days, said teacher may be compensated with days donated by other bargaining unit members. In a situation such as this, the Association will be permitted to receive names of members who will voluntarily donate sick leave days to the individual member. In the event that members are willing to donate more days than are necessary, a lottery-style drawing will select names of those who will participate. Teachers will be permitted to donate more than one sick day to an individual, if necessary. It is understood that participation in the Sick Leave Donation Plan is strictly voluntary. The Association will prepare all necessary forms for the implementation of this plan.

  • Sick Leave Donation Program A Labor Management Committee will be established for the purpose of proposing rules and procedures for a new, program. The LMC will be to develop consistent, transparent and equitable proposals for processes across all departments within the City. The LMC shall also explore proposals to lower the minimum leave bank required to donate sick leave and permit donation of sick leave upon separation from the City. The LMC must consult with the Office of Civil Rights to ensure compliance with the City’s Race and Social Justice Initiative. Once the LMC has developed its list of proposals, the City and Coalition of City Unions agrees to reopen each contract on this subject.

  • Sick Leave Donation 10.3.1 A worker may donate days of sick leave to individual District workers who, due to a serious health condition, have exhausted all accumulated sick leave. Donating workers must retain a sixty (60) day balance of sick leave after their donation. No worker may receive more than 40 days of donated leave per year. 10.3.1.1 A “serious health condition” is defined as an illness, injury, impairment or physical or mental condition which involves inpatient care in a hospital, hospice, or residential health care facility, or continuing treatment or continuing supervision by a health care provider as defined in 29 USC 825.114(a) and as certified by a worker’s physician or other qualified medical practitioner. 10.3.1.2 The Vice Chancellor of Human Resources and the Chief Stewards by mutual agreement will verify the certification for eligibility. If the certification from the worker’s physician is insufficient, a certification by a physician of the District’s choosing may be required, at District expense. The District may require additional medical opinions. 10.3.2 Donated leave must be in one-day increments (no less than 8 hours). Recipients of donated sick leave shall be solely responsible for any state and federal taxes on the donated time. Such taxes shall be withheld at the normal rate for the recipient worker. In the event that the state or federal governments rule that tax liability is due other than as taxed, the recipient shall be solely liable for such liabilities. 10.3.2.1 The donated sick leave may be used only when the worker has exhausted accumulated sick leave and either is not eligible for long- term disability or is eligible but has not begun to receive the long-term coverage. 10.3.2.2 The Vice Chancellor of Human Resources shall be notified of solicitation of donations. Solicitations of donations may be made by the individual or his/her representative(s). 10.3.2.3 Donation of sick leave shall be authorized by a signed pledge form prepared by and filed with the District Office of Human Resources. In the event several workers donate sick leave, the sick leave shall be used in the order in which the signed pledge forms are filed with Human Resources. 10.3.2.4 If the worker does not use all donated sick leave, the sick leave shall be returned to the donating worker(s).

  • Sick Leave Plan The benefits of the Company’s Sick Leave Plan shall be considered as part of this Agreement. However, it is recognized that its provisions are not an automatic right of an employee and the administration of this plan and all decisions regarding the appropriateness or degree of its application shall be vested solely in the Company. The Company’s Sick Leave Plan will provide that probationary and regular employees will commence with a credit of eight days at 100 percent (100%) and 15 days at 75 percent (75%) pay, payable from the first day of sickness. This credit will continue to be available until the employee attains his/her first annual accumulation date as a regular employee. At the time of this accumulation date and each subsequent accumulation date he/she will acquire additional credits of eight days at 100 percent (100%) pay and 15 days at 75 percent (75%) pay. The accumulation of credits will be subject to the provisions of the Company’s Sick Leave Plan. Regular part-time employees shall receive a pro-rated number of sick days. When a regular part-time employee is absent due to illness on a scheduled day of work, they shall be paid for the hours of work scheduled for that day provided sick leave credits are available. Normally employees will be expected to arrange routine medical or dental appointments during non-working hours. Where such appointments cannot be arranged during non-working hours and the employee can be released from his/her duties, then the time shall be charged against an employee's sick leave time except in the case of medical appointments of less than half a day where normal earnings will be maintained. Employees who are on sick leave for 30 days or more may be eligible to participate in a vocational rehabilitation program in accordance with the Company’s policy. All major medical absence forms will be completed for any absence of four (4) continuous days/shifts or more or when requested by management. The Company will compensate the employee for the cost associated with completing these forms up to a maximum of $30.00. Additionally, the company will compensate the employee for the full cost of all medical notes, medical forms or medical information required to support LTD or other Wellness programs. This provision applies to Doctor’s notes requested by Line Management as part of the administration of the sick leave plan. Employees will be required to submit all forms required by management through their personal physician. Sick Leave benefits are conditional upon receipt of these forms and it is the responsibility of the employee to ensure that the employer receives these forms within a reasonable period of time. Any discipline related to sick leave that is imposed and grieved by the union will be referred directly to Xxxxxx Xxxxxxxxx for resolution.

  • VACATION PLAN 2 All employees in the bargaining unit shall earn paid vacation time 3 under this Article. Vacation benefits are earned on a fiscal year 4 basis--July 1 to June 30. 5 8.1 Unit members are entitled to vacation with pay at the rates 6 to be found in the following schedule: 7 8.1.1 . 83 of a day for each month worked during the first 8 three (3) years.

  • Sick Leave Policy It is the policy of the State of Ohio to not unreasonably deny sick leave to employees when requested. It is also the policy of the State to take corrective action for unauthorized use of sick leave and/or abuse of sick leave. It is further the policy of the State that when corrective and/or disciplinary action is taken, it will be applied progressively and consistently. It is the desire of the State of Ohio that when discipline is applied it will serve the purpose of correcting the performance of the employee.

  • Sick Leave Benefit Plan The Sick Leave Benefit Plan will provide sick leave days and short term disability days for reasons of personal illness, personal injury, including personal medical appointments and personal dental appointments.

  • Leave Donation Program Employees may donate paid leave to a fellow employee who is otherwise eligible to accrue and use sick leave and is employed by the same Agency. The intent of the leave donation program is to allow employees to voluntarily provide assistance to their co-workers who are in critical need of leave due to the serious illness or injury of the employee or a member of the employee's immediate family. The definition of immediate family as provided in rule 123:1-47-01 of the Administrative Code shall apply for the leave donation program. A. An employee may receive donated leave, up to the number of hours the employee is scheduled to work each pay period, if the employee who is to receive donated leave: 1. Or a member of the employee's immediate family has a serious illness or injury; 2. Has no accrued leave or has not been approved to receive other state-paid benefits; and 3. Has applied for any paid leave, workers' compensation, or benefits program for which the employee is eligible. Employees who have applied for these programs may use donated leave to satisfy the waiting period for such benefits where applicable, and donated leave may be used following a waiting period, if one exists, in an amount equal to the benefit provided by the program, i.e. fifty six hours (56) pay period may be utilized by an employee who has satisfied the disability waiting period and is pending approval, this is equal to the seventy percent (70%) benefit provided by disability. B. Employees may donate leave if the donating employee: 1. Voluntarily elects to donate leave and does so with the understanding that donated leave will not be returned; 2. Donates a minimum of eight hours; and 3. Retains a combined leave balance of at least eighty hours. Leave shall be donated in the same manner in which it would otherwise be used except that compensatory time is not eligible for donation. C. The leave donation program shall be administered on a pay period by pay period basis. Employees using donated leave shall be considered in active pay status and shall accrue leave and be entitled to any benefits to which they would otherwise be entitled. Leave accrued by an employee while using donated leave shall be used, if necessary, in the following pay period before additional donated leave may be received. Donated leave shall not count toward the probationary period of an employee who receives donated leave during his or her probationary period. Donated leave shall be considered sick leave, but shall never be converted into a cash benefit. D. Employees who wish to donate leave shall certify: 1. The name of the employee for whom the donated leave is intended; 2. The type of leave and number of hours to be donated; 3. That the employee will have a minimum combined leave balance of at least eighty hours; and 4. That the leave is donated voluntarily and the employee understands that the donated leave will not be returned. E. Appointing authorities shall ensure that no employees are forced to donate leave. Appointing authorities shall respect an employee's right to privacy, however appointing authorities may, with the permission of the employee who is in need of leave or a member of the employee's immediate family, inform employees of their co-worker's critical need for leave. Appointing authorities shall not directly solicit leave donations from employees. The donation of leave shall occur on a strictly voluntary basis.

  • Sick Leave Abuse ‌ When the Employer suspects sick leave abuse, the employee will be provided the opportunity to explain the circumstances surrounding their sick leave use prior to disciplining the employee, or making reference to sick leave use in the employee’s performance evaluation. The Employer may not adopt or enforce any policy that counts the use of paid sick leave time as an absence that may lead to or result in disciplinary action for an authorized purpose. The Employer may not discriminate or retaliate against an employee for the use of paid sick leave for an authorized purpose.

  • Sick Leave Incentive The City will institute a sick leave incentive based on the usage of the bargaining unit; further, the City will pay each person who qualifies during January of each year. The incentive will be calculated and monitored by the Personnel Department and will be based on the pay periods during a calendar year. The incentive shall be awarded only when the bargaining unit's average sick leave usage is less than the City average and the following conditions are met: When the bargaining unit's sick leave usage is greater than forty (40) hours but less than the City average, the City will pay each member using between zero (0) and sixteen (16) hours of sick leave, eight (8) hours pay and any member using more than sixteen (16) but equal to or less than twenty-four (24) hours, four (4) hours pay. When the bargaining unit's average sick leave usage is equal to or less than forty (40) hours, the City will pay each member who used between zero (0) and sixteen (16) hours, sixteen (16) hours of pay at their current hourly rate. Those members who used more than sixteen (16) but equal to or less than twenty-four (24) hours, will receive eight (8) hours of pay.

  • Sick Leave Pay A Nurse granted sick leave shall be paid for the period of such leave at her or his regular hourly rate of pay and the number of hours thus paid shall be deducted from the accumulated sick leave credits of the Nurse.
