TEACHER AND ASSOCIATION RIGHTS. X. Xxxxxxxx to Act 379 of the Public Acts of 1965, the Board hereby agrees that every employee of the Board shall have the right freely to organize, join, and support the Association for the purpose of engaging in collective bargaining or negotiation and other concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under color of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any teacher in the enjoyment or any rights conferred by Act 379 or other laws of Michigan or the Constitution of Michigan and the United States of America; that it will not discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association, his/her participation in collective professional negotiations with the Board, or his/her institution
B. The Association and committees authorized by the Association shall be allowed the use of school building facilities in accordance with the current school facility use policies and forms. The Association will be allowed the use of established communication facilities exclusive of television.
C. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off school premises.
D. The Board agrees to furnish to the Association in response to reasonable requests to the Superintendent all available information which is public information concerning the financial resources of the district, including but not limited to: annual financial reports and audits, register of certified personnel, budgets, agendas and minutes of Board of Education meetings, treasurer’s reports, census and membership data, names and addresses of all teachers, curriculum committee meeting minutes, and building construction reports if available. In addition the Board agrees to provide at the district’s expense a copy of the Board Book and/or including handout to the Association President within two (2) days of each School Board meeting.
E. The Association shall be encouraged to appoint committees to study such matters as school finance, construction, and policy so that the advice of such committees shall be presented to the Board of Education at the end of each semester and/or as requested by the Board.

TEACHER AND ASSOCIATION RIGHTS. A. Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every employee of the Board shall have the right to freely organize, join and support the Association for the purpose of engaging in collective bargaining and negotiations.
B. The Board undertakes and agrees that it will not discriminate against any teacher with respect to hours wages, or any terms or conditions of employment by reason of his membership in the Association or negotiations or his institution of a grievance, complaint, or proceeding under this Agreement or otherwise with respect to any terms or conditions of employment.
C. The parties specifically recognize that each has the right to invoke the assistance of the Michigan Employment Relations Commission, or a mediator from such public agency, or an arbitrator appointed pursuant to the provisions of this Agreement.
D. The Association shall be granted Fourteen (14) Association days per year. The Association shall pay for the substitute for any days used in excess of six (6) days per year. The Superintendent or his designee shall be notified at least one week in advance of such leave. D. The Association shall have the right to use the school building facilities after regular school hours for official business of the Association providing said use has first been cleared with the Administration.
E. The Board agrees to furnish the Association in response to written request from time to time such information as is available concerning the financial resources of the district, Treasurer's reports, census and membership data, names and addresses of all teachers and all other information that will assist the Association in developing constructive programs and which may be necessary for the Association to process any grievance.
F. Nothing contained herein shall be construed to deny or restrict any teacher rights he may have under the Michigan General School Laws. The rights granted to each teacher hereunder shall be deemed to be in addition to those granted elsewhere.
TEACHER AND ASSOCIATION RIGHTS. The Board agrees that teachers shall have the right to organize for the purpose of engaging in bargaining for mutual aid and protection. The Board further agrees that it shall not directly or indirectly discourage, deprive, or coerce any teacher in the enjoyment of any right conferred by this Contract, laws of Indiana, or the Constitutions of Indiana and the United States; that it shall not discriminate against any teacher by reason of employee membership, participation in employee organization activities or collective bargaining with the Board or institution of any grievance, complaint or proceeding under this Contract. All rights and privileges of the exclusive representative granted by law or this agreement shall be granted to the Association as the exclusive representative and not to any other teacher organization as defined in I.C. 20-7.5-5-1-2(1). A teacher's and/or the Association's election to pursue a claimed violation of this paragraph as a grievance past Level II shall constitute a binding election of remedy which shall bar the teacher or Association from pursuing the same matter before the Indiana Education Employment Relations Board.

As a duly elected body exercising government power under color of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any teacher in the enjoyment of any rights conferred by Act 379 or other laws of Michigan or Constitutions of Michigan and the United States; that it will not discriminate against any teacher with respect to hours, wages or any terms or conditions of employment by reason of his/her membership in the Association or any other teacher organization, his/her participation in any activities of the Association or of any other teacher organization, his/her participation in collective professional negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under this Agreement, or otherwise, with respect to any terms or conditions of employment.
B. No teacher shall be prevented from wearing insignia pins or other identification of membership in the Association or any other teacher organization either on or off school premises. Bulletin boards and other established media of communication shall be made available for the use of the Association and its members, in an area not frequented by students. Such use will be appropriate and professional in nature.
C. The Association and its members shall have the right, upon previous notification to the building principal, to use available school facilities for meetings between the close of school and 10:00 p.m. provided such school buildings have night custodial personnel. Meetings whose activities may exceed the 10:00 p.m. limit may also be arranged for by previous notification to the building principal.
D. The Board agrees to furnish, without cost, to the Association in response to reasonable requests, all information in the format available concerning the financial resources of the District and other such reasonably available information as will assist the Association in negotiations and implementation of this Agreement and in the processing of any grievance.
E. The Board will continue to provide for inservice workshops for all teaching staff on a released-time basis....
TEACHER AND ASSOCIATION RIGHTS. A. Pursuant to Act 379 of the Public Acts of 1965, the parties agree that all teachers recognized in Article I, paragraph A shall have the right freely to join and support the Association.
B. Every teacher assigned to a building will be provided a key to the designated door(s) of his/her building. Teachers assigned keys will be responsible to reimburse the cost of a lost key, which may include the cost to re-core building locks, if necessary. Guidelines for appropriate building/equipment use will be distributed.
C. The Association and its members shall have the right to use school buildings and related facilities without charge, provided such use has been approved by the Superintendent of Schools, or his agent. It is understood that a custodian will be on duty in the building, and such use shall not interfere or interrupt normal school operations. The Association may also use the inter-school mail and the bulletin boards located in the teacher's lounge or dining room.
D. A copy of the Board agenda shall be sent to the Association representatives in each building prior to the Board meeting. A copy of the minutes, with exhibits titled, shall be sent to the Association representatives the day following the Board meeting.
E. Copies of all information concerning financial resources of the district that are official or published will be sent to the Association within one week of their receipt from governmental or public sources upon request. Two copies of budgets, amendments and allocations will be made available to the Association within one week as each item is approved by the Board.
F. All available information which is necessary to the processing of any grievance will, with the written approval of the teacher involved, be available to the Association, except information found only in the confidential file of the teacher.
G. The private and personal life of any teacher is not usually within the appropriate concern or attention of the Board.
H. Teachers shall be permitted to wear appropriate insignia, pins or other identification of membership in the association on school premises provided the identification does not exceed three (3) square inches.
I. Each teacher shall have the right to review his personal file under the direction or supervision of the Superintendent of Schools who is the custodian of such files.

Pursuant to Act 379, P.A. of 1965, as amended by Act 25 of P.A. of 1973, the Board hereby agrees that every teacher employed by the Board shall have the right freely to organize, join and support the Association for the purpose of engaging in collective bargaining or negotiations. As a duly elected body exercising governmental powers under the laws of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any teacher in the employment of any rights conferred by Act 379; that it will not discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his membership in the Association, his participation in any activities of the Association or collective negotiations with the Board, or his institution of any grievance, complaint or proceeding under this Agreement, or otherwise with respect to any terms or conditions of employment.
TEACHER AND ASSOCIATION RIGHTS. 5.1 Teacher Protections

TEACHER AND ASSOCIATION RIGHTS. 4.1 Professional teachers shall have the right to form, join or assist professional teachers' organizations or participate in professional negotiations with the Board through representatives of their own choosing. Professional teachers shall also have the right to refrain from any or all such activities.
4.2 The Association shall also have the right to hold general membership meetings on School District property.
4.3 The Association shall be provided with bulletin board space in the school.
4.4 The Association shall have the right to use faculty mailboxes for appropriate announcements.
4.5 A. A copy of all notices for regular or special meetings of the Board of Education will be placed in the Association President's mailbox at least forty-eight (48) hours prior to the meeting. The time parameter may be waived in emergency situations. In such cases, the President will be informed either orally or in writing of the meeting.
TEACHER AND ASSOCIATION RIGHTS. 2.1 Teachers shall have the right to organize, join and assist the Association and to participate in professional negotiations with the Board through representatives chosen by the Association. Neither the Board nor the Association shall discriminate against any teacher by reason of his membership or non-membership in the Association, participation in negotiations with the Board or the institution of any grievance, complaint or proceeding providing that such is as per the provisions of this agreement and follows the procedures outlined in this agreement.
2.1.1 The Association shall be notified of any and all Board meetings in writing by placing a notice in the mailbox of the Association President and Vice-president at the time the meeting is posted for the public. During the summer months, the Association President and Vice president will be notified by e-mail notice to the Association President and Vice-president at the time the meeting is posted for the public.
2.1.2 The administration will investigate and determine the validity of complaints brought to their attention. No unsubstantiated or anonymous complaint shall be used in the evaluation process.
2.2 Each bargaining unit member, as a condition of his/her employment, on or before thirty (30) days from the date of commencement of duties or the effective date of this Agreement, whichever is later, may choose to join theAssociation.
2.3 The Board shall not discriminate against a teacher for reason of race, creed, color, marital status, sex or national origin.
2.4 When a teacher is required to appear before the Board or an administrator for a formal discussion concerning circumstances which might adversely affect his/her employment, position or salary, the teacher shall be given prior notice of the reason(s) for the meeting. A meeting with the administrator shall take place at a time agreed upon by both the teacher and the administrator, but in the event there is no agreement, the meeting shall take place during the teacher’s preparation period. The teacher may, if he/she so requests, have a member of the Association present. The teacher’s representative shall be a member of the Association chosen by the teacher but shall be a teacher who is free from duties at the time of the meeting. When circumstances permit, the meeting shall take place within two working days of the notification.

TEACHER AND ASSOCIATION RIGHTS a. This Contract supersedes and cancels all previous agreements whether verbal or written between the School Corporation and the Association as well as any alleged past practices of the School Corporation and this Contract constitutes the entire agreement between the parties.
b. Any individual contract between the Board and an individual teacher shall be consistent with the terms and conditions of this Contract.
c. If any provisions of this Contract or any application of this contract to any employee or group of employees is held to be contrary to law, then such provision or application shall not be deemed valid.
d. The Board will grant to the Association president, or to his/her designee if approved by the Superintendent, seven (7) paid Association leave days for the purpose of attending to Association business, in accordance with the rules governing personal leave, and the Association shall reimburse the Board for the cost of a substitute teacher.
e. The Board will continue to grant teachers the right to any other payroll deduction program now in existence or outlined in administrative guidelines.
