Vacation Rules. Vacation benefits are subject to the following computations and rules:
A. Entitlement of vacation and/or vacation pay shall be based on continuous service with the Employer and is applicable only to bargaining unit members. In computing service for vacation purposes, full credit shall be given for all service rendered in a probationary status, provided such member immediately after probationary status becomes an employee eligible to receive vacation.
B. Vacation periods for all classes of service shall not be cumulative, except as provided in Section 21.3, and shall be taken during the year earned or forfeited. In no event shall an employee be permitted to take in excess of 288 hours of vacation (if on a 6/2 schedule) or 240 hours of vacation (if on a 5/2 schedule) in any calendar year.
C. Periods of vacation by employees shall be so arranged by the Chief of Police so that the department shall at all times be adequately serviced by a sufficient number of employees. All scheduling shall be done so as to hold overtime hours to a minimum.
D. Insofar as possible, police officers and sergeants and lieutenants, having rank and seniority of service, shall be given preference as to vacation periods. However, during the course of vacation selections, no employee shall be permitted to schedule more than 144 consecutive hours of vacation (if on a 6/2 schedule) or 120 consecutive hours of vacation (if on a 5/2 schedule) of vacation on the employee’s first pick in any calendar year unless every employee within the group affected approves of same. Vacation shall not be scheduled except at the individual employee's discretion and shall not be involuntarily scheduled. In the event it becomes necessary due to an unforeseen depletion in staffing caused by accident or illness, cancellation of vacations will occur in order of reverse seniority and rank (i.e., least senior police officer first, then least senior sergeant, then least senior lieutenant, etc.). Vacations that are cancelled may be rescheduled or carried over into the subsequent year in addition to that as provided in Section 21.3.
E. Sergeants and lieutenants vacation scheduling preference shall not be affected by any other bargaining unit’s vacation scheduling prior to April 1. All vacation requests per shift will be granted so long as there is at least one (1) supervisor regularly scheduled to work. Vacation Rules. The following rules shall govern the use of vacation:
A. A member who is separated from City service through removal, reassignment, retirement or a layoff and who has unused vacation leave to his or her credit, shall be paid in a lump sum for such unused vacation leave to his or her credit at the time of separation.
B. Upon the death of a member, any unused vacation leave to his or her credit shall be paid in a lump sum to the surviving spouse or, secondarily, to the estate of the deceased. The leave shall be paid out at the member’s current rate of pay at the time of death.
C. All vacation hours shall be paid in full pay at the applicable straight time rates.
D. Members on vacation leave may be recalled to duty for extraordinary situations as determined by the Employer; however, if a member is ordered to work while on approved vacation leave he or she shall be paid at one and one-half (1½) times his or her regular rate of pay for all hours worked. The period of time the member is called back to work will not be deducted from his vacation time.
E. Vacation time shall be taken in increments of at least one (1) hour, unless otherwise approved by the Chief.
F. Vacation credit shall not be earned while a member is in non-pay status (unpaid leave of absence, disciplinary suspension, etc.).
Vacation Rules. Purpose: To clarify the procedure for scheduling vacations for those assigned to the patrol division. Process: The following should be adhered to when scheduling Lieutenant, Sergeant, and Patrol Officer Vacations: Sergeant and Lieutenant Vacation scheduling shall not be affected by any other bargaining unit's vacation scheduling prior to April 1, as it pertains to each particular choice. As such, vacation shall be scheduled in the following order: First Choice: Shift Lieutenant Shift Sergeant Patrol Officers (by seniority) Second Choice: Shift Lieutenant Shift Sergeant Patrol Officers (by seniority) Third Choice: Shift Lieutenant Shift Sergeant Patrol Officers (by seniority) **This process shall continue until vacation choices are exhau sted. **No more than one supervisor and one patrol officer, or two patrol officers may be off on vacation leave at a time. Two supervisors may not overlap vacation days. The City of Barberton and the OPBA have engaged in numerous discussions over Section 1.2, formerly titled Unit Assignments of the labor agreement. The OPBA does not want the City to use reserve sworn officers to work traditional beats in the place of full time officers. The City agrees that reserve officers when working a beat in a patrol car will only be used to supplement the beat car. The OPBA does not want the City to use reserve officers to substitute for full-time officers where traditionally full-time officers were hired by the City at overtime rates. Examples would be parades and fireworks. The City agrees that reserve officers will not take the place of full-time officers at these events, but will use reserve officers at these events to supplement the normal compliment of full-time officers. The City wants to use reserve officers working by themselves for a variety of functions as indicated in 1.2. The OPBA agrees that they may do so.
Vacation Rules. 1. Pursuant to resolutions adopted by the Trustees of the Operating Engineers Local 101 Vacation Fund, and effective for the life of this agreement, or until otherwise amended by said Board of Trustees, the Trustees shall accumulate all credit contributions made pursuant to Article XIV, Paragraph 3, of this agreement into the corpus of the Trust for crediting to an Employee Account.
2. All contributions for work in covered employment shall be credited to each Employee Account when received and duly processed.
3. Not less than once per Plan Year, the Vacation Fund will disburse to each Employee all employer contributions credited to the Employee Account through the last day of the month preceding the month in which the payment is made, as well as any distributable interest or earnings accruing on said Employee Account through the same date, to be used to cover vacation and holiday periods when the employee will not be working.
Vacation Rules. 29.4.1 A full-time employee’s vacation year will begin on May 1.
29.4.2 A newly hired employee will receive a prorated vacation entitlement starting from their hire date up to May 1.
29.4.3 Vacation entitlement for full-time employees will be calculated based on completed years of service.
29.4.4 Vacation credits earned in a vacation year should be used in the same vacation year. If vacation is remaining, only one year shall be carried forward.
29.4.5 For members that receive vacation pay (i.e. permanent part time employees) these individuals will be paid a percentage in accordance with the chart above on each bi- weekly pay.
29.4.6 Illness while on vacation - an Employee who has been hospitalized for a period longer than three working days (verified by a medical certificate) while on vacation, shall be able to request from his/her supervisor that the vacation days be replaced by sick days and the vacation days be rescheduled for another time.
29.4.7 The employer reserves the right to determine when vacation is scheduled. All vacation must receive prior approval from a member’s supervisor.
29.4.8 The above change from anniversary date to May 1 each year will take place on May 1, 2021.
Vacation Rules. A. Vacation days shall be allocated as of July 1, of each year.
B. If an eligible employee starts in a position after July 1, the employee will be given the prorated amount of vacation for the remainder of that year.
C. For those employees working four (4) or more but less than eight (8) hours per day, vacation shall accrue on a pro-rata basis.
D. An employee shall be reimbursed for all unused vacation to a maximum of 20 days, upon submission of a written resignation with 30 days of notice. An employee’s daily rate of pay for the purpose of this payout shall
E. Employees must submit a written request for vacation to their supervisor at least four (4) days in advance. Request for vacation is subject to the approval of the supervisor.
F. Employees accrue vacation during a particular fiscal year (July 1 to June 30). Up to 10 days of unused vacation accrued as of June 30 of each year may be carried over into the new year and must be used by the following January 31 or will be forfeited unless otherwise approved in writing by the District.
G. If the employee resigns before completing six (6) months of service, the employee shall not be entitled to any vacation pay and shall have the salary paid for any vacation days taken deducted from the employee’s final check. An employee who has completed at least six (6) months of service shall be entitled to receive the pro- rata pay for unused vacation time provided such employee provides the District with at least two (2) weeks of advance notice of the employee’s resignation time, unless such termination is by reason of death or disability.
Vacation Rules a. Employees should attempt to use vacation time in the year earned. Its use must be requested by the employee and approved by the First Selectman or his designee. Pay will not be granted in lieu of vacation time.
b. An employee may carry over, by permission of the First Selectman, a maximum of one- half (1/2) of the employee's earned vacation days from one year to the following year only.
c. Choice of vacation dates by employees shall be granted whenever practicable without jeopardizing business needs of the Town, taking into consideration the work responsibilities of the employee, as determined by the First Selectman or his designee.
d. An employee who becomes ill while on vacation leave may not charge such illness to sick leave unless the illness exceeds three days and the employee files a physician's certificate documenting the duration of the illness, with the First Selectman.
e. Employees shall be paid at 100% of their earned vacation time, upon being laid-off, retiring or quitting with two (2) weeks’ notice of termination, unless such termination is for serious misconduct including, but not limited to: carrying weapons, proven recklessness resulting in a serious accident, deliberately damaging Town equipment or property, deliberately falsifying Town records, or stealing Town funds or property. In the event of termination for serious misconduct, an employee shall not be eligible to receive payment for accrued unused vacation time.
f. Vacation time will be tracked on a half-hourly basis.
g. Any and all time off with pay, including vacation time, must be requested in advance with a "Time Off Request Form," which must be approved by the employee's supervisor. Vacation should be requested at least one week in advance of the date(s) requested.
Vacation Rules. (a) The vacation year shall be from July 1st to June 30th, inclusive.
(b) The Union and the Employer recognize the need for employees to take their vacation.
(c) For vacation time between July 1st and December 31st employees shall make written request for vacation by March 15th and the Employer shall respond in writing by April 1st, indicating whether or not the employee’s request is granted.
(d) For vacation time between January 1st and June 30th, employees shall make written request for vacation by October 15th and the Employer shall respond in writing by November 1st, indicating whether or not the employee’s request is granted.
(e) Any vacation not requested by the deadlines outlined in articles 22.02 (c) and (d), may be requested and approved on a first come, first served basis.
(f) Vacation shall be awarded based on seniority.
(g) Employees shall earn vacation in advance after completing the probationary period, and utilize their entire vacation entitlement in the vacation year, unless there is mutual agreement between the Employee and Employer that the Employee may postpone a portion of her vacation to a subsequent year. The vacation schedule may be modified during the vacation year by mutual agreement of the Employee and Employer.
(h) An Employee who, upon separation from Community Inclusion Society who has been advanced vacation leave, shall repay Community Inclusion Society for the annual vacation leave that was taken but not earned.
(i) An Employee, upon separation from Community Inclusion Society, shall be paid for vacation leave which was earned but not yet taken.
