WORKWEEK AND OVERTIME. 17.1 (a) The School District agrees that the basic work week for bargaining unit employees shall be forty (40) hours, scheduled as need arises and at the discretion of the Chief of Police. When an employee is scheduled to work on a Saturday and/or on a Sunday, that employee will be paid his/her regular hourly rate except when working on that Saturday and/or Sunday would constitute overtime within the meaning of the Fair Labor Standards Act (FLSA). Any hours in excess of the forty (40) per week will be compensated at the rate of one and one-half (1.5) times the officer’s regular hourly rate. Forty (40) hours will be calculated in accordance with the FLSA.

The Joint Committee’s report will be an item subject to being negotiated in 2014 and if a negotiated agreement is reached, the seniority wheel will be implemented upon ratification.

The District must authorize and approve all timesheets. However, timesheets will not be changed for time changes without the initials approval of both the employee and the supervisor acknowledging agreement of the change. No employee shall be required to remain on duty for more than forty (40) hours in any calendar week unless extra hours of duty are deemed necessary by the Chief of Police, and additional compensation shall be paid thereupon. The purpose of Section 207(k) is to allow public employers to balance the hours of work over an entire work period. 1. The Patrol Division will utilize the 4/12 work schedule. 2. During the period the 4/12 schedule is in use, the City will suspend the forty (40) hour work week as defined in this Agreement for employees assigned to the 4/12 schedule. Overtime will be compensated at a rate of one and one-half (1½) times for any hours worked in excess of those regularly scheduled for that employee within any calendar week under the 4/12 schedule. Employees working the 4/12 schedule (without additional overtime hours as described above) shall be compensated for eighty (80) hours plus one-half (½) of an hour (thirty (30) minutes) at the employee’s overtime rate each pay period, by exception, regardless of actual hours worked under the 4/12 schedule.
