OVERTIME AND OVERTIME RATES. 20:01 An employee required to return to work within sixteen (16) hours from the start time of his regular shift will be paid the applicable overtime rate. 20:02 Employees will receive time and one-half (1.5) for all hours worked on Saturday and all hours worked in excess of eight (8) hours in a day. All shifts scheduled on Sundays, paid holidays, a Saturday that falls on a long weekend, or those in excess of twelve (12) hours per day shall be paid at the rate of double time. 20:03 For off-shift workers, unless otherwise agreed upon the shift which commenced on the evening of the holiday shall be considered as the shift for that holiday. 20:04 The Company will endeavour to equalize overtime among the employees usually performing the work within their classification and shift as follows: (a) In the event of overtime scheduling, the lowest overtime employee shall be asked; however, it is agreed that when the overtime listing is posted in the plant and prior to any overtime commencing, the employee must bring forward any errors or omissions to his/her Supervisor first, and if there is no resolution, then the employee will bring the matter forward to his/her union representative for review. (b) For the purposes of overtime scheduling, with the exception of the Production Operator and Loader/Packer/Operator classifications, the order for asking is as follows: (1) Employees on-shift in classification; (2) Employees off-shift in classification; (3) Employees on-shift holding back-up positions; (4) Employees on-shift with the skill and ability to perform the work; (5) Employees off-shift with the skill and ability to perform the work. Overtime for the Production Operator and Loader/Packer/Operator classifications will be offered to all seniority employees by classification by shift, then to any off-shift employees who have not been scheduled to work and make themselves available or agree to work a double shift or who inform the Company they wish to work outside their classification, then probationary employees, and then TPT’s in that order. For weekend and holiday overtime it is the responsibility of the employee to notify the Company, by the end of their Tuesday shift, of their desire to work a double shift, out of class, or off-shift overtime in the Production Operator / Loader/Packer/Operator classification. OVERTIME AND OVERTIME RATES. (a) Overtime shall be paid for all time worked in excess of the normal full- time day [seven (7) hours], or normal full-time week [thirty-five (35) hours]. (c) The following provisions apply to Employees classified and paid at Levels 6, 7 and 8 of the core scale, Xxxxx 0 of the school operational services stream scale and Levels 7 and 8 of the nursing stream scale: (i) Employees classified and paid at Levels 6, 7 and 8 of the core scale, Xxxxx 0 of the school operational services stream scale and Levels 7 and 8 of the nursing stream scale are engaged in senior professional roles with the general expectation that they will perform such work as is necessary for the job, including working reasonable additional hours and, on occasion, as necessary, hours outside of the usual span of hours for their employment stream. (ii) Matters to be taken into account in determining whether a requirement to work additional hours is reasonable or unreasonable and an Employee's right to refuse to work such hours, are set out at sub-clause 31.1(e) below. (iii) The salaries payable to Employees in these streams and at these levels are inclusive of compensation for any on call or recall allowance, and overtime payments for reasonable additional hours worked to which the Employee would otherwise be entitled under the provisions of this Agreement, subject to paragraphs (iv) - (viii) of this sub-clause 31.1(c) below. OVERTIME AND OVERTIME RATES. All work in excess of eight hours in any regular work day shall be compensated at overtime rates. Employees shall receive time and one half their regular rate of pay for the first three hours of overtime in any one work day, and double time their regular rate of pay for all hours of overtime thereafter in any one work day. Overtime work on Saturdays, Sundays and Holidays shall be compensated at double the employees’ regular rate of pay, except as herein specifically provided. Employees requested to work on Satur­ days shall be guaranteed four hours of work at double the regular rate of pay whether the four hours are worked or not. The start­ ing time for Saturday work shall be 8 a.m. and the quitting time shall be 12 o’clock noon or one o’clock as hereinafter provided. Recognizing that the Employer to be con­ sistent with good business practice cannot adhere strictly to the hours set forth above, it is hereby further mutually agreed and stipulated that an employee may be required to work an additional hour to 1 p.m. on Saturdays for a total of five hours at the rate of double the employee’s regular rate of pay, but if the employee works beyond the fifth hour, he then shall be paid at double his regular rate of pay for a full eight hours whether he works the full eight hours or not. OVERTIME AND OVERTIME RATES. 18:01 Overtime All overtime is paid at a rate of time and one half (1½) the employee's hourly rate for all work performed in excess of forty-four (44) hours in a one week period. All overtime shall be approved by the department manager prior to being worked. Where an employee is scheduled to work and they are sent home for their regular scheduled hours, such hours lost will be counted as hours worked for the purpose of counting towards the requirement above for payment of overtime, except for where the reason for being sent home is for circumstances beyond the control of the company.
OVERTIME AND OVERTIME RATES. (a) An Employee is required to work reasonable overtime subject to the provisions of clause 19.1(b) (b) An Employee may refuse to work overtime in circumstances where the working of such overtime would result in the Employee working hours which are unreasonable having regard to: (i) any risk to Employee health and safety; (ii) the Employee's personal circumstances including any family responsibilities; (iii) the needs of the workplace or enterprise; (iv) the notice (if any) given by nbn of the overtime and by the Employee of his or her intention to refuse it; and (v) any other relevant matter. (c) Daily ordinary hours are arranged in accordance with clause 18.4 or 18.6. All work done in excess of the daily ordinary hours by an Employee Monday to Friday will be paid at the rate of time and a half for the first three hours and double time thereafter. All overtime worked by an Employee on a Saturday will be paid at the rate of time and a half for the first three hours and double time thereafter. All overtime worked by an Employee on Sunday will be paid at double time. (d) In computing overtime, each day’s work will stand alone. (e) Employees who are late starting or are absent for part of their ordinary hours on unpaid leave will complete their ordinary hours for that day prior to the entitlement to overtime.
