REDUCTION IN FORCE AND SENIORITY. 9.1 Reduction in Force (RIF) shall be implemented only in the event of financial constraints, reduced enrollment, or staff realignment or discontinuance of some particular type of teaching service. Employer will follow the Illinois School Code. 9.2 A seniority list shall be developed between September 1 and February 1 of each school year. Teachers shall have fifteen (15) days from the date the list is distributed to notify the superintendent in writing of any errors in the seniority list. The seniority list shall list teachers in order of seniority in the district. Seniority shall attach from the first day of service to the school district. Teachers will be granted seniority in the area that they are currently teaching and any other for which they are qualified. Approved leaves shall not interrupt seniority. Teachers having equal seniority by the method shall be ordered by the criteria in the following order until the tie is broken: 1. Length of total teaching service. 2. Highest degree attained.

Reduction in force due to a fis cal xxxx is , a natural diminution in the number of s tudents in a program or at the College or a reduction of programs shall be effected in full accordance with the applicable statutes of the State of New Jersey and effective regulations promulgated thereunder, particularly N.J.A.C. 9:4-5.1. B. Except as otherwise provided in Section A of this Article, seniority for faculty members shall be based upon the total number of years of full-time teaching in a department, except where a faculty member has taught in more than one department in which case seniority shall be based upon the total number of years of full-time teaching at the College, or in the case of full-time members of the professional library s taff, seniority shall be based upon the total number of years of full-time professional work in the library. If two faculty members have the same seniority but are in different academic ranks, the faculty member in the higher academic rank shall be deemed to have greater seniority or if they are in the same academic rank, the faculty member firs t appointed to that rank shall be deemed to have greater seniority. a. If a faculty member desires to obtain qualification to teach in areas other than his/her own discipline, the faculty member will submit a plan for undertaking such retraining to the Academic Vice President for his or her review and approval. The Academic Vice President will consult with the Department Chairperson and credentials committee of the department to which the faculty member seeks admittance. If the Academic Vice President judges the plan to be satisfactory and the area in which the faculty member(s) wish to be retrained is appropriate to the needs of the College, the College will agree to fund the retraining effort of the faculty member(s) while following said plan.
REDUCTION IN FORCE AND SENIORITY. 4.01 A reduction in force shall be defined as the abolishment or reduction of a bargaining unit position and a corresponding suspension of contract, in whole or in part. Prior to any formal action to authorize a reduction in force by suspension of contracts, the Board shall give a minimum of twenty (20) school days' advance notice in writing to the Association President. Such notice shall include the reason(s) for the reduction, the number of positions affected, and their location by building and department or grade level. The number and type of bargaining unit positions required to implement the District's educational program will be determined annually by the Superintendent and reviewed by the Board of Education. Reasons for reduction in force by suspension of teaching contracts (layoffs), in whole or in part, shall not be limited by the provisions of O.R.C. 3319.17. A. Board action to suspend contracts for reduction in force under this Article shall only occur during the month of May for reductions to be effective at the start of the succeeding school year, except for reductions occasioned by a teacher's return from a leave of absence. B. Prior to Board action suspending contracts, all internal assignments, reassignments, and / or transfers will be finalized to the extent possible and any affected or potentially affected bargaining unit members will be provided notice and a list will be provided to the Association President. C. The number of persons affected by a reduction in force will be kept to a minimum or avoided by not employing replacements insofar as practical for employees who retire or resign or whose limited contracts are not renewed. To achieve educational aims, however, it may be necessary to hire some replacements for some positions if other employees in the system do not possess the certification/licensure, qualifications and experience for the position and the position is one that needs to be filled. Attrition, moreover, may not be sufficient to accomplish a reduction in force in full.
REDUCTION IN FORCE AND SENIORITY. If and when the Employer shall deem it necessary to reduce the professional staff, the following shall apply: If the furlough(s) cannot be avoided through normal attrition, members shall be retained on the basis of seniority rights acquired through continuous employment in the Southern Lehigh School District in any or all areas of certification. Seniority shall include those years taught in the districts, which have been consolidated into the Southern Lehigh School District. Full seniority will accrue to involuntarily demoted part-time employees. Seniority shall continue to accrue during furloughs and all approved leaves of absences. Members of the bargaining unit shall be permitted to exercise seniority rights only after tenure is granted. Members of the Bargaining Unit cannot exercise seniority rights into any area in which they are not certified. Should there be more than one (1) employee with exactly the same number of days of seniority in the same area of certification, the individual whose name appears last in the school board minutes of the meeting at which these employees were initially hired shall be considered the least senior employee. Conversely, the first name that appears in the school board minutes shall be considered the most senior employee of the group. If it appears a reduction in staff is necessary, the Employer shall meet with the Bargaining Agent prior to the notification of the employee(s) involved, for the purpose of discussing possible methods of avoiding employee furloughs. This meeting shall be held no later than August 1 of each year. The Employer shall also give at least thirty (30) calendar days advance notice of layoff/suspension to the employee(s) involved and to the Bargaining Agent. The final determination of the number of professional employees to be furloughed, according to Section 1124 of the PA School Code, shall be reserved to the Employer and shall not be subject to the Grievance procedure or arbitration under the terms of this contract. Furloughed teachers annually, at the anniversary date of the furlough, must report to the Employer in writing his/her intent to accept the same or similar position when offered. It shall be the responsibility of the furloughed employee to notify the Employer, in writing, of any address change. A recall position shall be defined as 1) a professional vacancy; or 2) an opening in excess of 90 teacher-day duration. Recalled employees shall be compensated at their current salary placement...
REDUCTION IN FORCE AND SENIORITY. In the event it becomes necessary to reduce the number of teachers with professional status included in the bargaining unit as defined in Article I, the following procedures shall apply: 1. The Superintendent shall make every effort to accomplish said reduction by attrition. 2. A teacher with professional status shall not be laid off if there is a teacher without professional status whose position the teacher with professional status is qualified and certified to fill. 3. In the event the reduction cannot be accomplished by attrition, then the least senior teacher within specific areas of certification shall be laid off first, except that the Superintendent may lay off a more senior teacher within specific areas of certification whenever the less senior is on a higher academic salary track pursuant to Article XXIII, Appendix A or the less senior teacher is demonstrably superior in teacher evaluation. Where teachers are substantially equal, seniority shall govern. A teacher who has displaced a less senior teacher because of certification in a subject area or teaching level without recent teaching experience in such subject area may be required to obtain, at his/her expense, up to three graduate credits or participate in in-service training as directed by the Superintendent if his/her teaching performance in such new position is rated less than satisfactory by the administration during the first year in such new position. 4. Seniority shall mean a teacher’s total continuous length of service in years, months and days from the initial date of service for the Grafton Public Schools. In cases where more than one teacher’s length of service commences on the same school day the order of placement on the seniority list shall be established as follows: a. those with long-term substitute service immediately preceding their appointments will be placed on the list, with the teacher who has the greatest amount of long term substitute service being placed first. If service time is equal, a random drawing will be held to determine placement as outlined in b. below. b. a random drawing of remaining teachers will establish specific placement on the seniority list. The first name chosen in any such drawing shall be credited with more seniority than any name or subsequent names drawn in that procedure. In the event it becomes necessary for the Committee to reduce the number of professional employees in the bargaining unit because of financial limitations, reasons of economy, decreases in pupil enrollment, changes in curriculum or other similar reasons the procedures set forth in this Article will govern the layoff and recall of employees who are affected by any such reduction. 2. The Committee shall have the sole discretion in determining which position or positions are to be eliminated. 3. In determining which of its employees are to be laid off to accomplish any such reduction in force the Superintendent will take into consideration the qualifications of employees for the position to be eliminated, the quality of past performance of such employees and their seniority as employees of the Committee. Where, in the opinion of the Superintendent, the qualifications and quality of performance of employees are substantially equal, employees will be laid off in the order of their seniority as employees of the Committee, those with the least seniority to be laid off first. Any grievance arising out of or with respect to the decisions of the Superintendent made under the provisions of this Paragraph 4, other than a grievance arising out of a determination of an employee's seniority, may be processed only through Level Three of the said Grievance Procedure. Level Four of said Grievance Procedure, which provides for the submission of a grievance to formal arbitration, shall not apply to any such grievance. 4. Seniority as used herein shall mean an employee's continuous length of service in years, months, and days in the bargaining unit. Whenever date of appointment or employment is referred to in this Agreement, it shall mean the date of the professional employee's actual entrance on duty. a. Employees shall be credited for seniority purposes up to a maximum of one (1) year with time spent on any leave of absence provided for in this Agreement. Notwithstanding the foregoing sentence, time spent on unpaid leaves of absence, except for maternity, paternity, unpaid sick leave, or layoff, shall not count toward the maximum of one-year seniority. Unpaid leaves of absence which do not count toward seniority shall not be deemed to interrupt continuous service. b.
