SICK LEAVE AND FUNERAL LEAVE. X. Xxx (10) days of leave with pay, to be used for sickness or death, injury, or serious illness in the immediate family (spouse, children, parents, siblings, grandchildren or any other family member residing in the immediate household) or personal business as specified below will be granted to each employee July 1 of each year of this agreement. It is to be considered as granted on the basis of one day for each month of service during the year. In the event the employee does not serve the entire year, leave days will be allocated at one day for each full month of service. This leave may accumulate from year to year to an unlimited maximum number of days.
X. Xxxxxxxx, as used in this section, shall be construed as to include personal physical illness, emotional stress, disabling personal injury, exposure to a contagious disease, or serious illness or death in the employee’s family. Funerals other than described above may be attended through use of a personal business day.
C. Each year two of the sick leave days shall be granted for personal business days to take care of urgent business that cannot be otherwise transacted. The employee shall notify the Supervisor, in writing, at least three (3) days in advance, except in case of emergency the supervisor shall not be obligated to accept more than one application on any given day or days. The personal business day is not to be used the day immediately preceding or immediately following a vacation or holiday, except in case of an emergency. The personal business day can be used the day immediately preceding or immediately following a personal unpaid vacation day.
D. Any employee drawing benefits under Xxxxxxx’x Compensation may elect to be reimbursed the difference between that compensation which is being received and the individual’s regular salary to the extent of the monetary value of the accumulated paid leave days.
E. If at the close of the preceding school year an employee shall not have used more than two (2) sick days (including personal business days) and shall have accumulated thirty (30) sick leave days, then, in the following year the employee shall be entitled to one (1) “earned day” to be taken at the employee’s discretion upon previous notification of at least one (1) school day to the Supervisor of Food Services. SICK LEAVE AND FUNERAL LEAVE. Section 1. Each full-time firefighter assigned to a forty (40) hour workweek schedule shall accrue sick leave at a rate of one hundred twenty (120) hours per year, prorated over twenty-six (26) two-week pay periods, and the maximum number of sick leave hours which can be accrued by such firefighters shall not exceed 2,080. Firefighters assigned to a 24-48 schedule shall accrue sick leave at a rate 1.4 times the rate of a firefighter assigned to a forty (40) hour workweek schedule or 168 hours per year, prorated over twenty-six (26) two- week pay periods, and the maximum number of sick leave hours which can be accrued by such firefighters shall not exceed 2,912. When a firefighter is transferred from a forty (40) hour workweek schedule to a 24-48 schedule, any balance of sick leave will be multiplied by 1.4. When a firefighter is transferred from 24-48 schedule to a forty (40) hour workweek schedule, any balance of sick leave will be multiplied by five- sevenths (5/7).
Section 2. Sick leave may be used for absences due to illness, injury, or exposure to a contagious or communicable disease, or emergency due to serious illness of a member of the immediate family where the employee’s presence is extremely essential, but a doctor’s certificate to substantiate periods of three consecutive days or more may be required by the City, and may also be required for a period of one (1) day in the following cases:
a. For probationary employees;
b. If it is believed that an employee is malingering based upon repeated one or two day absences; or
c. Multiple absences on a single day (5 or more employees).
Section 3. In case of any illness or other absence, the employee shall notify his department as soon as possible on the first day of absence unless it is impossible to do so, in which case notice shall be given as soon as possible. If the absence extends beyond one (1) day, the employee shall make periodic reports to his department on his progress and anticipated date of return. Firefighters will be required to notify their department if possible at least one (1) hour prior to their scheduled starting time so that replacement help may be provided. Failure to notify his department of the reason for absence may be grounds for refusal to pay leave.
Section 4. Nothing shall prevent the City from investigating sick leave.
Section 5. Fraction of a day. Absence for a fraction of a day is chargeable to sick leave in accordance with these provisions.
SICK LEAVE AND FUNERAL LEAVE. Section 10.1. Every seniority employee covered by this Agreement who works a fifty-six (56) hour work week schedule shall accrue twelve (12) hours of sick leave allowance for each completed calendar month of service. When a fifty-six (56) hour employee actually uses a day of sick leave, he/she shall have twenty-four (24) hours deducted from his/her accumulated unused sick leave. Every seniority employee who works a forty (40) hour work schedule shall accrue eight (8) hours of sick leave allowance for each completed calendar month of service. When a forty (40) hour employee actually uses a day of sick leave, he/she shall have eight (8) hours deducted from his/her accumulated unused sick leave. Such sick leave allowance may only be used by an employee when incapacitated to perform his/her duties due to sickness or injury, or when quarantined, or in the event of a serious illness or death in the employee's immediate family. All foreseeable leaves for such purposes shall require specific prior approval of the Director of Police and Fire Services. In the event of sick leave for any purpose, the Director of Police and Fire Services may require a certificate of a medical doctor or other competent professional individual giving information as to the circumstances involved. The immediate family, for these purposes, shall be regarded to include the parents, current spouse, children, brothers, sisters, grandparents, grandchildren and current parents-in-law.
A. The rate of accrual and usage of sick leave allowance as described above shall be initially computed by this method retroactively to the date each current employee in the unit was hired as a sworn officer in the Xxxxxxx Fire Department.
B. In order to accumulate sick leave for any given month, an employee must actually work one hundred twenty (120) hours or be on Worker's Compensation, vacation or holiday.
C. Effective July 1, 1991, the City hereby agrees to pay retirees after that date an amount equal to one hundred percent (100%) of salary for unused sick leave at the time of retirement with a maximum of seven hundred twenty (720) hours accumulation.
D. It is understood and agreed that sick leave will not be abused. An employee who makes a false claim for paid sick leave shall be subject to appropriate disciplinary action depending on the circumstances involved.

SICK LEAVE AND FUNERAL LEAVE. 11 Section 1. Sick Leave
SICK LEAVE AND FUNERAL LEAVE. A. Each employee covered by this Agreement will be entitled to sick leave accumulated in a single sick leave bank at the rate of ten (10) days per year accumulated to forty-five (45) days maximum, and days accumulated over forty-five (45) will be reimbursed at a rate of forty percent (40%) of the employee's normal daily wages with the maximum of ten (10) days reimbursable at the end of each school year. No employee with excess of forty-five (45) days will lose them except by use. It is understood that part-time employees shall be entitled to a pro-rated portion of all benefits provided under this paragraph and other paragraphs of this Agreement.
B. After five (5) consecutive days of illness, the employee must present a doctor's written permission slip of good health to be able to return to work. The Employer may require a doctor’s written verification of illness or disability for an employee that is absent from work more than one
(1) day per month.
C. Sick leave shall be granted to an employee when he/she is incapacitated from the performance of his/her duties by sickness, injury, or for medical, dental or optical examination or treatment. Sick leave shall also be granted when a member of the immediate family of the employee requires the care and attendance of the employee due to illness or injury.
SICK LEAVE AND FUNERAL LEAVE. A. Each employee shall be credited with sick leave of 0.0577 hours for each hour worked not to exceed one hundred twenty (120) hours per year. Vacation shall count as hours worked for this paragraph.
B. Employees may use sick leave, upon approval of their supervisor and the Superintendent, for absence due to personal illness, pregnancy, injury, exposure to contagious disease, and/or illness, injury or death in the employee’s immediate family.
1. Bargaining unit members will be granted three (3) days of funeral leave not deducted from their accumulated sick leave total providing one (1) of the three (3) days paid leave is the day of the funeral which the bargaining unit member must attend within a 200 mile radius from Cambridge Ohio. If the day of the funeral is on a Saturday or Sunday, bargaining unit members will be granted one (1) day of funeral leave not deducted from their accumulated sick leave total providing the funeral is within a 200 mile radius from Cambridge, Ohio.
2. Bargaining members who must travel outside the 200 mile radius may receive up to five (5) days funeral leave providing one (1) day is the day of the funeral, and the two additional days are deducted from the bargaining unit member’s sick leave accumulation. If the day of the funeral is on a Saturday or Sunday, bargaining unit members may receive up to three (3) days of funeral leave and the one (1) additional day is deducted from the bargaining unit member’s sick leave accumulation.
C. Accumulation of sick leave shall be unlimited.
D. When sick leave is used, it shall be deducted from the employee’s credit on the basis of one-half (1/2) hour for one-half (1/2) hour of absence. Xxxx leave pay is based on the employee’s regular salary only. (Supplemental contracts, bonuses, etc., are not included).
E. Previously accumulated sick leave of an employee, who has been separated from public service in an Ohio public agency shall be placed to his credit upon his reemployment in this public service, proved that such reemployment takes place within ten (10) years of the date on which the employee was last terminated for public service in Ohio.
F. Each employee is required to furnish a satisfactory written, signed statement to justify the use of sick leave. If medical attention is required, a certificate stating the nature of the illness from a licensed physician shall be required to justify the use of sick leave. Each full time employee covered by this Agreement will be entitled to sick leave accumulated in a single sick leave bank at the rate of one (1) day per full school month (9) nine, part-time employees shall receive pro-rated portion of sick days per school month worked with a limit of 100 days. It is understood that part-time employees shall be entitled to prorated portion of all benefits provided under this paragraph and other paragraphs of this Agreement.
B. 1. Sick leave shall be granted to an employee when incapacitated from the performance of duties by sickness, pregnancy, injury or for medical, dental or optical treatment; provided, that an employee must immediately notify the Employer in the case of pregnancy and shall then be granted a leave of absence immediately. Sick leave shall also be granted when a member of the immediate family of the employee is afflicted with a contagious disease and requires the care and attendance of the employee or when through exposure to contagious disease, the presence of the employee at their employment positions would jeopardize the health of others. The Employer may request a medical certification from a physician to verify that failure to work was due to illness.
