VACANCY AND PROMOTIONS. 7.1 The parties agree that all appointments to vacancies covered by this Agreement shall be filled in accordance with this Article. 7.2 Whenever the Employer determines that a permanent vacancy exists in a bargaining unit position, a notice of such vacancy shall be posted on the employee's bulletin board for five (5) days. Such notice shall contain a description of the duties, pay scale, and work location(s). During the posting period, employees wishing to apply for the vacant position shall do so by submitting a written application to the Employer. During the summer months, notices of vacant positions in the bargaining unit shall be mailed to nine (9) month employees no later than the initial date of posting. The Employer may reassign individuals or bus routes to accommodate student needs and parental/guardian requests. 7.3 The vacancy shall be awarded to the senior employee who is qualified to perform the duties of the position. Should the most senior employees possess the same seniority the position will be awarded to the most qualified individual as determined by the Employer considering the following criteria: qualifications, experience, education, work record, previous job performance, demonstrated ability to work with the physically and mentally impaired, disciplinary record, physical and mental capability. 7.4 Once the selection has been made, the Employer will notify all employee applicants of the selection. 7.5 Nothing in this Article shall be construed to limit or prevent the Employer from temporarily filling a vacant position pending the Employer's determination to fill the vacancy on a permanent basis. 7.6 Bargaining unit employees may apply and be considered for vacant non-bargaining unit positions. If such positions are not filled by current non-bargaining unit employees, then qualified bargaining unit employees shall be considered ahead of any outside applicant. The most qualified individual will be employed. Employees not meeting the qualification required may request to meet with the appropriate administrator and discuss the reasons as to why they were not selected for the position. 7.7 An employee who moves into a job which has a higher pay scale will move to the lowest step which gives him/her an increase in pay. Section 2. Whenever the Employer determines that a permanent vacancy exists, a notice of such vacancy will be posted on the employeesbulletin board for ten (10) working days. Anyone wishing to apply for the vacant position shall do so by submitting a written letter of interest/e- mail to the Employer. The Employer shall not be obligated to consider any applications submitted after the posting date, or if the employee does not meet the minimum qualifications for the job. The employee has an active disciplinary action in their file, in accordance with Article 11, Section 3. Prior to employment, potential employees applying for a position where a physical is required by the state will submit to an examination by a licensed physician. In the event that the Employer provides the licensed physician for such physical examinations, the Employer shall assume all costs. If the Employer does not provide a licensed physician and requires the employee to take such physical examination, the Employer will reimburse the employee for such examination upon receipt of the completed medical report and the physician’s statement of charges. As a part of a new employee’s orientation to the agency, a promoted employee’s orientation to a new position, or lateral transfer as described in Article 15, the Employer shall provide comprehensive training, including but not limited to, the following: 1. Agency policies concerning record keeping and confidentiality; 2. Agency guidelines including preferred dictation format and time frames; and 3. Orientation to agency forms and their whereabouts. Section 2. The position posting notice shall state the following: 1. Classification Title; 2. Pay Range; 3. Unit and Administrator; 4. Position Description; 5. Minimum Qualifications; 6. Person to contact if interested; 7. Deadline for submitting application; The Employer shall have a copy of the posting notice to the Union chief xxxxxxx on the first day of the posting. Section 3. Nothing in this article shall be construed to limit or prevent the Employer from temporarily filling a vacant position pending the Employer’s determination to fill the vacancy on a permanent basis, pursuant to Article 16, “Temporary Assignment and Pay.” Section 4. Section 2. Whenever the Employer determines that a permanent vacancy exists, a notice of such vacancy shall be posted on the employee’s bulletin board for five (5) working days (Appendix “A”). During the posting period, anyone wishing to apply for the vacant position shall do so by submitting a written application to the Employer (Appendix “B”), except as provided in Section 8 of this Article. The Employer shall not be obligated to consider any application submitted after the posting date or who do not meet the minimum qualifications for the job. Section 3. Nothing in this Article shall be construed to limit or prevent the Employer from temporarily filling a vacant bargaining unit position pending the Employer’s determination to fill the vacancy on a permanent basis. However, such temporary filling of a vacancy shall be posted in accordance with Article 14, Section 3 and limited to a sixty (60) day period for any one (1) employee during any six (6) month period. Selections for such temporary needs will be made on the basis of the most senior qualified available person as determined by the supervisor of that department based on job descriptions. Furthermore, laborers will only be used as a last resort. Section 4. All timely filed applications shall be reviewed and selection made by the Employer considering the following criteria; applicant’s experience, work record, qualifications, and seniority with seniority given preference by the Employer for such selection, when other qualifications are considered reasonably equal.

When the Employer determines that permanent vacancies or new jobs exist in positions covered by this contract, notice of each vacancy shall be posted within ten (10) calendar working days of the City’s decision to fill the vacancy on bulletin boards in each City department for a period of at least five (5) calendar working days. Job postings shall include: job title; job pay range; a description of the duties, responsibilities, and necessary skills required for the position; the date and time of posting; the number of the notice and the place to file applications. The times specified within this section can be accelerated by mutual agreement of the parties. Section 12.2. An employee wishing to be considered for the job shall make application on forms provided by the City and submit the application to the Personnel Director within the posting period. Section 12.3. Seniority and qualifications shall prevail in all cases. Seniority is one dominant preferred factor in determining who is employed to fill a position. Other factors to be considered for filling a job may be determined by appropriate written exams or skill tests, previous work experience or oral assessment interviews as the City may deem necessary. When testing is deemed appropriate, employees who score at or above the pre-established passing score will be deemed to be qualified. Skill tests, previous work experience, assessment interviews shall thereafter determine the best person to fill a new hire vacancy. Promotions shall be filled from a listing of current City employees who apply and who meet the precise qualifications desired for the promotional position. If employees are equally qualified, then seniority shall be the deciding factor in the job appointment. A. For the purposes of filling posted vacancies, seniority shall be city wide based on length of service, as defined as cumulative unbroken service with the City of Washington Court House. Section 12.4. In the filling of vacancies, the City shall give first consideration to existing employees who have applied for the position based upon their ability to do the work required, the quality of prior service, the length of service, attendance, and discipline.
