HOURS OF WORK, OVERTIME, ETC. 15.01 The normal work week for each employee consists of forty (40) hours.
15.02 If the company decides to change the shift rotation cycles the human resources manager shall discuss the matter in advance with the union.
(a) Employees who are required to work a straight eight (8) hour shift, including an allowance of twenty (20) minutes for lunch, shall have their lunch period paid for by the company.
(b) The company shall schedule each employee's lunch period at a regular time except on operations where it finds that regular scheduling is not feasible, and will avoid requiring an employee to take his/her lunch period at another time except where it has a particular need for the employee's services during that period. Where time permits, the employees affected will be notified well in advance of such change. Except in emergencies, an employee's regular lunch period shall not be advanced or delayed by more than one (1) hour unless the employee agrees to such change.
15.04 As far as reasonably possible, overtime shall be equitably distributed among employees in the same classification, provided that this provision shall not be construed as obligating the company to re-assign employees from one shift to another in order to effect such equitable distribution.
(a) An employee shall receive payment at one and one-half times his/her regular hourly wage rate for all time worked in excess of eight (8) hours in any one shift.
(b) An employee, except an employee employed on an operation which is scheduled as a continuous 7-day operation, shall receive payment at one and one- half times his/her regular hourly wage rate for all time worked on a Saturday.
(c) An employee employed on an operation which is scheduled as a continuous 7-day operation shall receive payment at one and one-half times his/her regular hourly wage rate for all time worked on a 6th shift within a calendar week.
(d) An employee who is required by the company to perform work on a shift other than his/her regularly scheduled shift shall receive payment at one and one- half times his/her regular hourly wage rate for all such time worked over eight (8) hours in any continuous period of twenty-four (24) hours.
(e) An employee shall receive payment at double his/her regular hourly wage rate for all time worked on a Sunday.
15.06 An employee, provided he/she has attained seniority, who performs work on the day of observance of one of the holidays specified in section 19.01 shall be paid for the time worked ...
HOURS OF WORK, OVERTIME, ETC. 15:01 The following is intended to define the normal hours of work for full time employees but shall not be interpreted as a guarantee of hours of work per day or per week or days of work per week.
15:02 The regular work shift for full time employees shall be eight (8) consecutive hours per day which includes one-half (2) hour unpaid meal period.
a) Employees shall receive a one-half (2) hour unpaid lunch or meal period;
b) Employees shall receive a paid thirty (30) minute rest period during each shift effective at the time to be designated by the Employer.
15:04 An employee who is unable to report for work because of sickness or other reasonable cause shall be expected to notify his immediate Supervisor at least three (3) hours before the start of the afternoon and night shifts and two (2) hours before the start of the day shift so that proper measures can be taken for replacement. For the purpose of this sub-article, a day shift is a shift beginning at or after 3:00 a.m., but before 11:00 a.m., an afternoon shift is a shift beginning at or after 11:00 a.m., but before 7:00 p.m., and a night shift is a shift beginning at or after 7:00 p.m., but before 3:00 a.m. of the following day. Failure to give adequate notice, unless such failure is unavoidable, may result in loss of sick leave benefits for that day of absence.
15:05 Shift schedules for a four week period shall be posted as far in advance as possible, but not later than fourteen days prior to the implementation of the schedule.
15:06 The Employer shall schedule a minimum of one weekend off in two for full time employees and one weekend off in three for part time employees. Employees will not be scheduled to work more than five (5) days straight, between days off. In order to maintain quality of care, employees on preferred shifts will be required from time to time to work day shift in order that such employee may receive a refresher course in training in her area. The Employer may require a particular employee on a preferred shift to transfer to days where her performance has necessitated additional training.
15:07 The Union recognizes that Employer's obligations to tenants will make overtime work necessary from time to time.
HOURS OF WORK, OVERTIME, ETC. The following is intended to define the normal hours of work for full-time employees but shall not be interpreted as a guarantee of hours of work per day or per week or days of work per week. The regular work shift for full-time employees shall be eight (8) consecutive hours per day which includes one-half hour unpaid meal period.
HOURS OF WORK, OVERTIME, ETC. 19.01 The following is intended to define the normal hours of work for part-time em- ployees but shall not be interpreted as a guarantee of hours of work per day of per week or days of work per week.
19.02 The regular work shift shall be seven and one-half (7 ½) hours per day or such hours paid as the employee is scheduled to work.
19.03 Employees shall receive one-half (½) hour for their meal during their shift, if the shift duration is for more than five (5) hours. Such meal period shall be without pay and shall not be considered as time worked. If an employee is required to work during their meal break, the employee will notify their supervisor or the Administrator, if available. If the entire half (½) hour meal break cannot be arranged, the employee will be paid for the portion of the meal break not taken at the rate payable for the shift. All efforts, will made to ensure the employee receives the entire half (½) hour meal break. A registered nurse on the night shift who is required to remain on site during their meal break will receive pay at regular time for the meal break.
(a) There shall be two (2) paid fifteen (15) minute break periods for all employees during each shift of more than six (6) hours at times designated by the Home. Short shifts of four (4) hours but less than six
HOURS OF WORK, OVERTIME, ETC. 19.01 The following is intended to define the normal hours of work for employees but shall not be interpreted as a guarantee of hours per day or per week, or days of work per week. In scheduling employees, the following guidelines will be used:
(a) For full-time employees, the normal work period shall be eight (8) hours per day and/or eighty (80) hours bi- weekly.
(b) The normal work week for part-time employees will be as determined by the Employer, but shall not regularly exceed forty-eight (48) hours scheduled bi-weekly. A shift for part-time employees shall not be less than four (4) hours in duration.
(c) Hours of work that become available after the schedule is posted, due to employees not reporting for work, as scheduled, or additional hours of work required by the Employer, shall, if required, be offered to the senior qualified part-time employee.
19.02 No employee shall be required to work split shifts unless agreed to by the employee. No portion of the split shift will be less than four (4) hours who has indicated her availability to work that shift.
(a) Employees scheduled five (5) hours or more will receive a one-half (½) hour paid lunch period.
(b) Employees required to work more than two and one- half (2½) hours’ overtime shall be provided with a meal by the Employer.
(a) Employees scheduled for six (6) hours or less shall be entitled to one (1) fifteen (15) minute paid rest period and employees scheduled for more than six (6) hours of work shall be entitled to two (2) fifteen (15) minute paid rest periods in each four (4) hours of work. It is agreed that no employee will be asked to take a break within the first one (1) hour to reporting to work.
(b) Shifts shall be arranged so that no part-time employee will be required to work more than seven
HOURS OF WORK, OVERTIME, ETC. 1. For the purpose of computing overtime, holiday hours, vacation time and pay, the following definitions shall apply.
(a) The Standard Service Week is a period of seven (7) consecutive days, starting at 12:01 a.m., on Sunday and ending at midnight on Saturday.
(b) The Standard Service Day is a period of twenty-four (24) hours, starting and ending at midnight on successive days.
(c) The normal work day shall be eight (8) prescheduled hours or ten (10), if an employee is scheduled for a four (4), ten (10) hour per day schedule.
(a) Except in cases in which the employee requests that the first forty (40) hours or less of his/her week’s work be scheduled on more than five (5) days per week, an employee who is scheduled to work on more than five (5) days of a service week will be paid at time and one-half (1½) for all time worked after the first five (5) scheduled days worked by such employees in such week. However, if an employee would be entitled to time and one-half (1½) pay under this paragraph (a), with respect to any particular hours worked, and he/she would also be entitled under any provision of this Article 9 to time and one-half (1½) or double time (2) pay for those same hours or any of them, such employee shall be paid under whichever one of the provisions of this Article 9 will give such employee the most total pay for the service week, but not under both.
(b) Except where a recognized or optional holiday falls on Saturday, an employee excused from work on such holiday shall have the number of hours he/she normally works per day counted toward the computation of weekly overtime for that week.
(c) Every employee shall be advised of his/her schedule for the next succeeding week before 3:00 p.m., on Thursday of the current week, and when not so advised, the employee’s schedule for the current week shall be considered as his/her schedule for the next week.
(d) The Company may change such schedules. However, if less than seventy-two (72) hours notice of such change is given the employee, all hours worked outside the posted schedule shall be paid for a time and one-half (1½) the employee's straight time rate, except when worked at the employee's request. When an employee is requested to work an extra tour or partial tour beyond those scheduled, it will not be considered a schedule change.
(e) In order to meet customer demands, it is understood that overtime work is necessary and that all employees are required to work a reasonable amount of such overtime...
HOURS OF WORK, OVERTIME, ETC. 15.01 No employee covered by this agreement is guaranteed hours of work per day, or per week, or days of work per week. Employees shall be offered work in accordance with their stated availability of the operating requirements of the nursing home are such that such work is warranted.
15.02 There shall be two (2) paid rest periods of fifteen (15) minutes in each full shift and pro-rated for employees working less than a full shift. A full shift shall mean seven and one-half (7 ½) consecutive hours worked, excluding meal periods and including rest periods.
15.03 A shift shall be deemed to be entirely within the calendar day in which the majority of hours fall regardless of what calendar day the shift commences.
15.04 Work schedules covering a two (2) week period will be posted thirty
HOURS OF WORK, OVERTIME, ETC. 15.01 The Home shall schedule full-time employees first and then the part-time employees. Full-time employees shall be scheduled up to a maximum of seventy-five
HOURS OF WORK, OVERTIME, ETC. 18.01 The following is intended to define the normal hours of work for full-time employees, but shall not be interpreted as a guarantee of hours of work per day or per week or days of work per week.
18.02 The regular hours of work shall be seven and one-half (7 ½) hours per day.
18.03 Employees shall receive at least one-half (½) hour for lunch during their shift. Except in the case of emergency or circumstances beyond the control of the Home, such lunch period shall be uninterrupted.
(a) There shall be a paid fifteen (15) minute break period in each half of the shift, as referred to in 18.02, for all employees.
(b) Shifts shall be arranged so that no employee will work more than six (6) consecutive days. The Employer will guarantee one (1) weekend off in two (2) weeks for full-time employees. Further, the Employer will endeavour to provide one (1) weekend off in two
HOURS OF WORK, OVERTIME, ETC. 19.01 The following is intended to define the normal hours of work for employees, but shall not be interpreted as a guarantee of hours of work per day or days of work per week. However, in the scheduling in the normal hours of work, the Home agrees that hours will be scheduled as follows:
(a) Employees on the call-in list shall be called in order of seniority on a rotational basis. Full-time employees who are not scheduled for seventy- five (75) hours in a two (2) week period may have their names added to the call-in list provided they have not chosen a reduction in bi-weekly hours as per Letter of Understanding #1. This call-in list shall be posted. Each call will be indicated on that part-time call-in sheet as to “worked,” “no answer,” “refused.” Succeeding call-ins will commence with the person listed below the last person to accept a call-in and so on, on a rotational basis.
