Probation and Seniority. A. All individuals newly employed for positions within the bargaining unit shall be considered probationary employees for the first sixty (60) workdays of their employment, excluding the summer months when school is not in session for those employees who are not scheduled to work during that period. During this probationary period, employees may be summarily discharged.
1. The sixty (60) workday probationary period shall be accumulated within not more than a six (6) month period which is part of the employee's regularly scheduled work year for the assigned position. If the probationary period is not completed within the six (6) months allowed, the employee shall be required to serve a new sixty (60) workday probationary period.
2. Employees successfully completing the probationary period as described, shall be entered on the seniority list of the bargaining unit, and shall rank for seniority purposes as described in Section B below.
3. The probationary period shall not affect wage adjustments that are due to an employee in accordance with the wage schedule.
4. The Union shall represent probationary employees for purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
B. Members of the bargaining unit shall accrue two types of seniority.
1. District-wide seniority shall be based on an employee’s last date of hire within the bargaining unit. When more than one employee is hired on the same date, seniority will be determined by the last four digits of the employee’s social security number (the lower the number, the higher the individual’s seniority).
a. Such seniority shall be used for the purposes of transfer, promotion, or the filling of vacancies resulting in a change in classification. After an employee has changed classifications in such a manner, he/she shall accrue classification seniority in accordance with Section 2 below.
b. Such seniority shall also be used for the purpose of determining the eligibility of employees for longevity payments.
2. Classification seniority shall be based on an employee's length of service within a classification, commencing with his/her first day of employment or, in the case of transfer or promotion, the employee's first day of work in a classification. Probation and Seniority. A. New employees hired into the unit shall be considered as probationary employees for the first sixty (60) work days. When an employee completes the probationary period he/she shall be entered on the seniority list using his/her first working date, after being hired, as his/her seniority date. The seniority list as presently constituted shall govern for individuals employed at present. If two or more employees begin work the same day, their seniority will be determined by lot. The UNION shall represent probationary employees for the purposes of collective bargaining with respect to salary, and conditions of employment except for discipline and discharge of the employee for other than UNION activity. An employee while on probation shall not be eligible for benefits.
B. The seniority list on the date of this Agreement will show the name and first work date of employees of the unit.
C. The employer will keep the seniority list up-to-date and will provide the Local UNION with up-to-date copies upon request, or at thirty (30) day intervals if changes have been made.
D. Part time Special Education Paraprofessionals hired after September 1, 1991 will accumulate seniority on a pro rated basis. An individual working 3 hours or more per day will accumulate full seniority. Someone working less than 3 hours will have their seniority prorated according to the following formula. If an employee works 1 hour per day they will accumulate .33 years of seniority, 2 hours per day yields .67 years of seniority and if employed 3 hours per day they earn 1 year of seniority.
Probation and Seniority. 1. Seniority Definitions
a. Bargaining unit seniority shall begin as of the first working date in a classification in the bargaining unit either as an APA or a Clerk.
b. Classification seniority shall begin as of the first working date as a Clerk or in a classification level as an APA covering by this Agreement. Employees may have dual classification seniority dates if they have worked in both classifications of APA and Clerk.
Probation and Seniority. 11.1 Seniority standing shall be granted to all employees covered by this agreement. All new employees shall be placed on the seniority list as of the first day of employment, upon the completion of a probationary period of sixty (60) working days of employment. Probationary employees may be discharged or disciplined by the Employer without the same causing a breach of this agreement or constituting a grievance. Seniority ties shall be broken by social security number. The employee with the highest last four digits of the social security number shall be placed ahead of others with the same seniority. Seniority for full time or part time paraprofessional staff shall be defined as total years of service from date of unit hire including leave and layoff periods.
11.2 An employee's seniority shall terminate:
A. If an employee resigns or is discharged.
B. If the employee is absent without properly notifying the Employer, unless a satisfactory reason is given.
C. If the employee fails to return to work within three (3) working days after being notified to report to work and does not give a satisfactory reason.
D. If the employee’s lay off period exceeds two times his/her seniority or reaches a five (5) year maximum.
E. If the employee retires.
11.3 The Employer shall prepare, maintain and submit to the Union the seniority list. The initial seniority list shall be submitted to the Union within thirty (30) days of the ratification of this agreement, with revisions submitted thereafter in April of each year.
Probation and Seniority.
A. Each new hire shall remain in probationary status for a period of not more than ninety (90) working days following the hire date. During the probationary period, the retention of the employee shall be solely and entirely within the discretion of the District. The release of an employee during the probationary period shall not be subject to the just cause or grievance procedures of this Agreement.
B. Seniority shall be determined from date of hire.
C. Seniority rights shall be lost for the following reasons:
1. Resignation
2. Discharge
Probation and Seniority. Employees who successfully complete their probationary period shall have their seniority status retroactive to their first date of work.
Probation and Seniority. 12.01 The probationary period for nurses shall be four hundred and fifty (450) paid hours. Seniority shall then be credited as of the date of employment and shall be cumulative.
12.02 Effective March 7, 1996, all newly hired casual nurses shall accumulate seniority on the basis of hours worked. Should such a casual nurse become full-time or part- time, seniority will be calculated from date of last employment.
12.03 Seniority lists of nurses covered by this Agreement showing institutional seniority shall be posted by the Employer by January 31st of each year.
12.04 All seniority, illness allowance, vacation and other credits obtained under this Collective Agreement shall be retained and transferred with the nurse if she is reclassified from full-time employment to part-time employment and vice-versa.
(a) (i) Prior to the appointment to a vacant, temporary vacancy of thirty (30) days or new position, the Employer shall post notice of the vacancy, temporary or new position, on bulletin boards for a minimum of ten
Probation and Seniority. 8.1 All the employees hired in a department shall be considered as probationary employees for the six months of calendar days and there shall be no seniority among probationary employees. On the sixty-first (61st) calendar day the probationary employee shall receive fringe benefits as listed in the Collective Bargaining Agreement as per department.
8.2 The Union shall represent probationary employees for the purposes of collective bargaining in respect to rates of pay, wages, and hours of employment. However, during the probationary period, the employer shall have the sole right to discharge, discipline, transfer, demote or layoff employees for any reason, except for Union activity, without regard to provisions of this Agreement and no grievance shall arise therefrom.
8.3 Probationary employees shall be considered as terminated rather than laid off in the event of a reduction in the work force and there shall be no requirement for the employer to rehire. In the event they are rehired at a later date, they shall then be treated as a new employee.
8.4 For all purposes of this Agreement, departmental seniority shall apply and shall be determined as follows:
A. After successful completion of the probationary period in that department, a departmental seniority date shall revert back to the first day of regular employment. In the event more than one employee has the same seniority date in that department, the Union shall conduct a drawing among the affected individuals to determine the correct position on the seniority list.
8.5 In September and March of each fiscal school year, the employer will provide the Local Union xxxxxxx a seniority list showing the names, job title, and seniority date of seniority employees. The most recent list submitted to the Union xxxxxxx be conclusive as to the seniority date and department seniority date of a listed employee unless the Union notified the personnel office, in writing, within 15 calendar days after receipt of the lists that a particular employee's seniority date is not listed accurately.
8.6 No employee who has been laid off and returns after rehire to a department in which he/she has already successfully completed the probationary period shall be required to serve an additional probationary period in that department in the classification from which he/she was laid off.
Probation and Seniority. 1 5.01 a) New full-time and temporary full-time employees shall serve a probationary period of five (5) calendar months provided, however, absences from work for any reason shall extend the probationary period by the length of the absence.
