PROMOTIONS, VACANCIES. Section 1. Every vacancy in all units and administrative positions shall be posted on the District’s website, through internal email, and through School Spring, or a similar online program. The Superintendent will make every effort to advertise all other vacancies as soon as they occur for a minimum period of five (5) school days. Such notice shall clearly set forth the specifications, qualifications, and compensation of the position, and the date by which the applications shall be filed with the Superintendent. During the summer vacation, copies of such notices will be provided to the President of the Groton-Dunstable Educators’ Association, Curriculum Coordinators and the employees of the Groton-Dunstable Regional School District.
Section 2. Such promotions shall be based upon the Superintendent’s judgment as to what will serve the best interest of the students, and the Superintendent will consider knowledge, ability, skill, efficiency, attendance, areas of certification, and evaluations of the applicants. Whenever the above factors are equal in the judgment of the Superintendent, the applicant with the longest tenure of employment in the system will be advanced, promoted or transferred. It is recognized that the final decision as to whom promotions are granted must rest with the Superintendent, and is not subject to the grievance and/or arbitration procedure. All applicants will be notified in writing of the disposition of their applications. Vacancies shall be filled by an applicant within the Groton-Dunstable Regional School District if his educational qualifications, experience and potential for the position are, in the opinion of the Superintendent, equal to those of any other applicants.
Section 3. Nothing in this contract shall prevent the Superintendent or Administration from making acting appointments in the best interest of the educational needs of the system until positions can be filled with permanent appointments as provided in this contract. Time spent in such acting appointments shall not be regarded as evidence of superior qualifications for the position.
Section 4. All openings for summer school and evening school positions and for positions under federal programs will be adequately publicized by the Superintendent in each school building as early as possible and teachers who have applied for such a positions will be notified of the action taken regarding their applications as early as possible.

PROMOTIONS, VACANCIES. 1. A promotion is a change in an open job classification which results in additional compensation during the regular work day. Promotions are not meant to include the taking on of additional duties within the same job classification or work involving overtime, shift differential or premium pay.
2. Whenever a vacancy in a position occurs, which position shall be considered to be a promotion within the meaning of Section A, or whenever a new job is created, the Employer shall publicize the same by giving written notice of such vacancy by posting the job classification and its duties. No vacancy shall be filled, except on a temporary basis, until such vacancy shall have been posted for five (5) working days.
3. Any employee may apply for a vacancy as defined in Sections A and B above. Promotions within the bargaining unit shall be made on the basis of seniority, qualifications and testing. Interested bargaining unit members will be given the opportunity to take a pre- qualifying written exam for working leader, utility worker, high school maintenance, grounds and maintenance technician. (All tests will be determined by management and will be subject to change.) A three (3) month waiting period is required before a retest will be allowed. (The skills of the working leader shall be determined by management and will be subject to change.) Upon appeal, the Chapter Chairperson or Chief Xxxxxxx, may review a bargaining unit members test scores. To be eligible for promotion to a working leader position the employee must have a good attendance record and no disciplinary record for the past two years. The employee must have successfully completed a hands on test to be considered qualified. If the employee is not given a position / promotion within two years, they must re-qualify. Seniority applicants meeting the established posted testing standards and qualifications shall have a personal interview with the building or department supervisor. The senior qualified applicant shall be given first consideration for a promotion in every case where the Employer has determined such senior applicant to have the qualifications, ability and experience for the specific position. Unsatisfactory attendance and/or discipline records may be grounds for not granting an employee a promotion.

PROMOTIONS, VACANCIES. A. When an opportunity for promotion to a higher classification or pay grade or vacant position arises within the bargaining unit covered by this Agreement, the most qualified, interested senior employee (except probationary employees) will be promoted from the bargaining unit before any new employee or employees are hired to fill such position or vacancy provided such employee is available on the Company’s active payroll and has the necessary qualifications. Where the qualifications of two or more qualified employees are substantially equal, the most senior employee will be promoted. The Company shall immediately announce promotion opportunities to all bargaining unit members at that specific geographical location via an all-employee email and Company web page for a minimum of five (5) business days, or a minimum of six (6) if necessary to touch upon two (2) workweeks.
B. The Company shall immediately announce all openings to all bargaining unit members when any promotion or vacant position becomes available. Notice of available bargaining unit classification openings at the location with a brief description of required qualifications shall be posted internally via email or internal Company web page, for a minimum of fourteen (14) calendar days. Openings may be concurrently posted externally; however, internal, qualified applicants will be given first consideration.

The Company shall immediately announce promotion opportunities to all bargaining unit members at that specific geographical location via an all-employee email and Company web page for a minimum of five (5) business days, or a minimum of six (6) if necessary to touch upon two (2) workweeks. Employees shall apply and submit a formal resume for promotional opportunities and may be asked to interview as part of the selection process.
B. When a vacant position or need for employee(s) arises within a workgroup, the Company will solicit trained volunteers from within said workgroup first, then post the opening via an all-employee email and Company web page for a minimum of five (5) business days, or a minimum of six (6) if necessary to touch upon two (2) workweeks.
(1) In cases where the Company intends a temporary reassignment (90 days or less):
(a) The solicitation will be announced in group meetings and employees will have two (2) business days to volunteer.
(b) The employee may be extended by mutual agreement between the Company and the Union.

PROMOTIONS, VACANCIES. LAYOFF AND RECALL
15.1 Seniority shall mean the employee's length of continuous service within the defined bargaining unit.
15.2 Seniority shall govern in all overtime (voluntary or mandatory), extra work, layoffs, recalls, and vacation schedules of employees covered by this Agreement. The Parties agree that when applying seniority to overtime and/or extra work, the employee must be licensed and qualified to perform the work.
