A.2.1 Academic librarians shall have the right to express opinions and to participate by means of their representatives in procedures as provided for in the appropriate Article concerning such matters as: the appointment and promotion of academic librarians; and the granting of merit awards.
Rights, Duties and Responsibilities. 34.01 It is recognized that Technical and Educational Resource Personnel play an important role in the delivery of the educational programs and services of the University.
34.02 Employees assist faculty, students, and staff in the use of the specialized facilities in which they work. Employees are responsible for the maintenance and security of, and instruct in the use of specialized equipment, facilities, and technology. As part of their duties, Employees provide assistance, advice, guidance, and information concerning the use of the resources within their areas. Employees may also contribute to the general functioning of the University through service on committees.
34.03 While Employees have the freedom to select, present, and discuss material needed to allow individuals to make informed and responsible use of areas and facilities and related techniques, the Employee's right to this freedom carries with it the duty to carry out this work in a professional and ethical manner.
34.04 The Employer recognizes that Employees have a right to pursue professional art and design activities outside of normal work hours without being subject to prescribed doctrine and institutional censorship. It is understood that any such work produced in University technical facilities shall not interfere with the normal use of such facilities by other members of the University community and that Employees shall be respectful of the rights and duties of other members of the University community in the production of such individual work.
34.05 It is recognized that Employees may express opinions including criticism of the University provided that in doing so the Employee shall show respect for the opinion of others, the Employee shall have due regard for the best interests of the University, the Employee shall make every effort to indicate that he/she is not acting as a spokesperson for the University, and such expression shall not interfere with the duties and responsibilities of the Employee under this Agreement and with the performance of their specific work tasks.

The rights, duties and responsibilities of the Member shall be governed by the Colorado Limited Liability Company Act (the “Act” codified in Colorado Revised Statues §7-80-100 et seq. as it may be amended from time to time). 2. Exercise by the District of the foregoing rights, duties, and responsibilities; the adoption of policies, rules, regulations, and practices in furtherance thereof; and the use of judgment and discretion therewith shall be limited only by the specific and expressed terms of this contract and shall conform with the laws of the State of California and any other applicable laws or legal requirements. The District retains its right to amend, modify, or rescind policies, procedures, and practices referred to in this contract in case of emergency. An emergency exists when the safety of students and staff or the property of the District is endangered. Determination of whether or not an emergency exists is solely within the discretion of the District and is expressly excluded from the provisions of the grievance procedure in Article XIV.

Sessional and part-time Academic Librarians and Counsellors are members of an academic community who share the responsibility for the collection, dissemination, and structure of knowledge in the University. It is the employer=s right to determine the job that is to be performed. Academic Librarians and Counsellors will be given a copy of assigned duties at the beginning of their employment appointment.

The Custodian shall be an agent for the Employer and the Employee to receive and invest contributions to the account, to hold and distribute account assets, and to keep adequate records and report thereon, all in accordance with the terms and conditions of this Agreement. The Custodian shall not be obligated or expected to commence or defend any legal action or proceeding in connection with this Agreement or such matters unless agreed upon by the Custodian and the Employee, and unless fully indemnified for so doing to the Custodian's satisfaction. The Custodian shall not be liable for interest on any cash balances maintained in the Account. The Employer and the Employee (and where applicable the Employee's beneficiary) shall prepare and file with the Internal Revenue Service and other government agencies such returns, forms and other information at such times as may be required by either of them. To the extent permitted by applicable law the Employee and the Employee's Beneficiary as appropriate, shall always fully indemnify the Custodian and save it harmless from any and all liability whatsoever which may arise in connection with this Agreement and matters which it contemplates, except that which arises due to the Custodian's negligence or willful misconduct. Rights, Duties and Responsibilities a) Beginning on January 3, 2024, Agency shall recruit, screen, interview, hire, and assign its employees ("Staff") to perform temporary and/or permanent employment in accordance with the terms and conditions set forth in this Contract.
b) Client shall provide Agency with job descriptions, qualifications, and other relevant information for each position to be filled.
c) Agency shall perform Minnesota Criminal background checks for all employees it selects for assignment to Client and will not assign unqualified personnel.
d) Agency, as the common law employer of assigned Staff, will pay wages and provide benefits offered by Agency. Agency will withhold, and transmit payroll taxes; provide unemployment insurance, and workers' compensation benefits.
e) Agency will comply with all federal, state, and local labor and employment laws, including, but not limited to, the Affordable Care Act and provisions applicable to the assigned employees of a staffing agency relating to minimum essential coverage and full-time employees. Client is free from indemnification under ACA.
f) Agency has the right to inspect the work site and address performance issues and to enforce Agency's employment policies.
g) Client will supervise Staff performing work and maintain control over business operations, products, services, and intellectual property.
h) Client will provide Staff with a safe working environment and appropriate training and safety equipment necessary to avoid contact with hazardous substances or conditions.
i) Client agrees not to change the Staff's assigned job duties without Agency's prior written consent.
j) Client will exclude Staff from their benefit plans and avoid making offers or promises related to Staff's compensation or benefits.
k) Client will report any injuries to Agency in a timely manner. Also, Client must submit information regarding any termination (including layoffs and voluntary quit) to the Agency.
Rights, Duties and Responsibilities. 1. Whenever a representative of an EMS provider, which is party to this agreement, feels it is advisable to request assistance from another EMS provider, which is party to this agreement, he is authorized to do so. Circumstances which could justify requesting aid under this agreement would include, but are not limited to, the following:
(a) unavailability of an ambulance for response within the service area in which a medical emergency has occurred;
(b) unavailability of resources for Advanced Life Support in circumstances where the patient would reasonably benefit from Advanced Life Support;
(c) a potential for prolonged or delayed response by an ambulance from the requesting jurisdiction;
(d) a major EMS incident in which the resources of the local EMS system are not adequate to provide effective and efficient pre-hospital care and transportation for the victims of the incident.
2. The EMS providers participating in this agreement and their personnel acknowledge the authority of the on-line Medical Control physicians to direct a mutual aid response under this agreement whenever the physician feels that such a response is within the patient's best interests.
3. Requests for mutual aid under this agreement will generally be coordinated through the Regional EMS Communications Center at University Medical Center. However, the EMS providers within a single county may agree to coordinate all requests for mutual aid among themselves through a single point within that county.
4. The representative of an EMS provider receiving a request for mutual aid under this agreement shall immediately take the following actions:
(a) determine if the requested apparatus and personnel can be spared in response to the request while continuing to provide reasonable protection to persons within its jurisdiction;
(b) determine the exact mission to be assigned in accordance with the plans and procedures drawn in support of this agreement or in support of the Regional Major EMS Incident Plan;
(c) dispatch the apparatus and personnel requested, or such apparatus and personnel as can be spared, with complete instructions as to the mission.
5. The rendering of assistance under the terms of this agreement shall not be mandatory, but the party receiving the request shall immediately inform the party requesting aid, for any reason, if assistance cannot be rendered.

Rights, Duties and Responsibilities. 5:01 The rights and responsibilities of a faculty member flow from the objects and purposes of the University which are the advancement of learning and the dissemination of knowledge, the intellectual, spiritual, moral, social and physical development of its members and students and the betterment of society; from his/her position as a faculty member; from the expectations of the University; from the requirements of the students; and from the legitimate claims of the community.
5:02 The primary rights, duties and responsibilities of a faculty member shall be those listed and described in clauses 5:23 to 5:37 inclusive.
5:03 A faculty member in fulfilling his/her duties and responsibilities shall deal ethically and fairly with colleagues and students and shall respect appropriate principles of confidentiality.
5:04 Faculty members are normally engaged on a full-time yearly basis from July 1 to the subsequent June 30. Faculty members shall fulfill their duties and responsibilities as specified in this Article, unless otherwise provided for in the letter of appointment or by reduction of duties and responsibilities as specified in this Agreement, or as specified in clauses 5:05 and 5:06. Faculty members shall meet the reasonable requirements and needs of students, colleagues and the University on a basis and at a location consistent with their obligations to undertake teaching, research/scholarship/creative activity and service activity.
5:05 A faculty member is entitled to take his/her uninterrupted annual vacation. The member may take part or all of his/her annual vacation at a time which shall be mutually agreed between the member and the Xxxx, or Head as designate of the Xxxx, to ensure the uninterrupted continuation and quality of program(s) of the University in which the member is involved.
