Xxxx Leave Bank. A voluntary sick leave bank shall be established whereby a certificated school employee, as defined herein in Article I, who is absent from assigned duties due to personal illness and who has utilized all sick leave, personal leave, and all other paid leave benefits of whatever nature may petition a committee, as established herein, for sick leave days from the bank under the following conditions:
1. The number of accumulated days in the bank shall not exceed two hundred sixty (260) days, provided, however, that (a) a veteran teacher who is not a current member of the bank may become a member by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th of any school year, and (b) a teacher who is newly hired in the school corporation shall have fifteen (15) days from the date of initial duty assignment, or until September 15th of any school year, whichever is later, during which time such teacher may choose to participate in the bank by contributing one (1) sick leave day, even though such contribution by such veteran or newly hired teacher would cause an accumulation of days in excess of the maximum specified herein;
2. Said employee may be granted days from the bank under the following conditions:
a. The teacher must have chosen to become a current member of and participate in such bank by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th each year, and such day contributed shall be nonreturnable to the employee. However, in the event that the number of accumulated days in the bank at the beginning of a school year is of sufficient number that a contribution of one (1) sick leave day by all teachers who are current members of the bank would cause the maximum number of days specified hereinabove in Paragraph One (1) to be exceeded, the current year's contribution by all such current members shall be suspended, except that in case the bank is depleted during the school year, the current year's contribution shall be assessed at the time of such depletion;
b. The teacher must have utilized and exhausted all paid leave benefits of whatever nature, including said teacher's own accumulated sick leave and personal leave;
c. Written certification will be provided from said teacher's physician substantiating the illness and certifying that the absence will continue during a period of at least ten (10) consecutive days following the utilization and exhaustion of ...
Xxxx Leave Bank. 1. Employees who have completed one or more years of service to the School District shall be eligible to participate in a sick leave bank. Each eligible employee who elects to participate in the sick leave bank shall donate one day from the 15 sick leave days credited each year until the sick leave bank accumulates 150 days. If at any time thereafter the sick leave bank reaches a level of 50 days, then every teacher who has elected to participate in the sick leave bank shall donate one sick leave day to the bank. Unused sick leave days in the bank at the close of the school year will carry over into the next year. Any teacher who wishes to rescind a prior election to participate in the sick leave bank may do so by submitting a letter to the Superintendent or his/her designee wherein the teacher specifies that he/she no longer shall participate in the sick leave bank.
2. A teacher who has elected to participate in the sick leave bank may request sick leave benefits from the bank if (1) the teacher has exhausted all his/her accrued sick leave; (2) the teacher is not eligible to receive long-term disability insurance payments; (3) the teacher presents physicians' statements and/or such other satisfactory medical evidence of disability or illness as the Sick Bank Administrative Committee may require; and (4) the Sick Bank Administrative Committee approves the request for sick bank leave. No employee may receive more than 40 days from the sick leave bank in any school year.
3. The Sick Bank Administrative Committee shall administer the sick bank. The Committee shall consist of two members appointed by the Association and one member appointed by the School Board. The Committee shall determine which applicants for sick bank leave are qualified to use the bank, how many days each applicant may use, and what information applicants must provide to the Committee. Decisions of the Sick Bank Administrative Committee shall be final, and shall not be subject to the grievance procedure.
Xxxx Leave Bank. 1. Bargaining unit employees will contribute a maximum of one hundred ten (110) days of sick leave to the sick leave bank for use as specified in this section. The contribution amount will be divided evenly between semesters. Should the days allocated for distribution in the first semester not be used during that semester the unused days will be available in the second semester. If any unused sick leave bank days are carried over as provided by Paragraph 2 of this Section, then the number of unused days will be equally divided between the first semester and the second semester.
2. If there are days remaining in the sick leave bank at the end of the year, employees who contributed sick leave days to the sick leave bank shall not have any of the remaining days returned to them. Up to thirty (30) unused sick leave bank days may be carried over from one year to the next.
3. The use of sick leave days from the bank shall be limited to employees who have used all of the accumulated sick leave days, have not yet met the elimination period for long term disability insurance, and suffer from a serious and/or chronic or long term illness. Sick leave bank days shall not be available for an employee on a day-to- day basis, unless used for a serious and/or chronic medical condition.
4. Requests for the use of sick leave bank days shall be provided to the Department of Human Resources and to the Association. All requests for the use of sick leave bank days must be jointly approved by the Director of Human Resources and the Director of the Association. The Association can decide to deny requests for the use of sick leave bank days if the employee used ten (10) sick leave bank days during the precious school year. Up to ten (10) sick leave days will be allocated to each eligible applicant. If there are sick leave days remaining in the bank at the end of the school year, they will be allocated on a pro-rated basis among eligible sick leave bank participants based upon the number of days for which an employee would have been eligible if there were no ten (10) day limitation. If there are days available after the pro-ration of days, those days will be carried over up to thirty (30) days.
Xxxx Leave Bank. 1. A Sick Leave Bank Committee will be appointed by the Xxxxxxx Education Association. One member shall be appointed by the Board. The Sick leave Bank Committee shall abide by the bylaws which are set forth in section 2 of this provision. The Board of Education shall be responsible for the accounting of said Sick Leave Bank and will provide an accounting of the accumulated days within the Sick Leave Bank when such accounting is requested by the Sick Leave Bank Committee.
Xxxx Leave Bank. Section 1: A Sick Leave Bank will be established to relieve a Teacher from undue financial burdens as a result of an absence from work due to the Teacher’s illness, injury, or incapacitation sufficiently severe to make the performance of their duties impossible. Sick Leave Bank leave shall not be used for parenting leave. A Teacher member of the Sick Leave Bank who has exhausted his or her personal leave and sick leave days shall be eligible to apply to the committee for an extension of sick leave benefits. Sick bank days shall not be granted beyond the period when a Teacher would or could be eligible to receive benefits of the School Corporation’s long- term disability program. Unused days in the Sick Leave Bank shall be carried forward to the following year.
Xxxx Leave Bank. The Frankfort-Elberta Area Teachers who wish to initially join a sick leave bank may do so only before the last Friday of September of that year by authorizing in writing that one day be taken from their sick leave for the year and credited to the bank. Membership will be continuing as long as the teacher remains employed with the school district. The Board of Education will match the total original days put in the bank each year. Each member will authorize one day each year, until a maximum shall be attained. The maximum shall be one hundred fifty (150) days plus the membership minus one. Any time that the days in the sick leave bank shall drop to less than twice the membership, each member shall be required to authorize another day deposited in the bank. The maximum number of days that any member shall be required to give in any one year shall be three (3). Any teacher who is a member can draw on the Bank only after his/her accumulated sick leave, emergency and personal business days have been depleted. Tenure teachers may automatically draw up to ten (10) days over the life of their employment with the Frankfort-Elberta Area Schools provided written application is made to the Superintendent of Schools. Upon application, additional days up to thirty (30) may be awarded by the Sick Bank Board. Probationary teachers may join the sick leave bank after one year in the district. Up to ten (10) days may be awarded by the Sick Leave Bank Board upon application. A Board shall be selected to administer the Sick Leave Bank. Two members shall be selected by the Board of Education and two by the participating members. This Board shall have the authority as specified under 4.3A to grant additional sick leave days from the sick leave bank under extenuating circumstances.
Xxxx Leave Bank. The Canton City Board of Education and the Canton Professional Educators' Association (CPEA) agree to administer a Sick Leave Bank according to the following:
1. A Sick Leave Bank Committee comprised of the Superintendent or his/her designee; the President of the Association or his/her designee; a bargaining unit member chosen by the Association and the Treasurer or his/her designee shall be appointed.
2. A Sick Leave Bank shall be established to provide sick leave benefits to bargaining unit members (excluding special substitutes) and administrative staff who had exhausted all their accumulated sick leave due to catastrophic or serious injury/illness suffered personally or by a family member that includes: employees, employee's spouse, employee's dependent and employee's children under the age of 18.
Xxxx Leave Bank. Catastrophic Leave Donation on a case-by-case basis where the District and the Association mutually agree: Any bargaining unit member may irrevocably donate up to two (2) earned and unused days of sick leave to another bargaining unit member who has suffered a long-term or catastrophic illness and who has fully exhausted all paid leaves, including difference pay. Catastrophic leave donations shall not apply to employees whose absence originated as an industrial illness or accident. This provision shall apply to a maximum of four (4) bargaining unit members annually. No bargaining unit member may receive more than twenty-two (22) days annually of donated sick leave. Once donated, the donation becomes irrevocable, even if the donation is not utilized. It shall be the responsibility of the Etiwanda Teachers’ Association to communicate these provisions to bargaining unit members and communicate requests for implementation to the district. The District will prepare and process related sick leave accounting documents.
Xxxx Leave Bank. The purpose of the Sick Leave Bank is to provide paid days for serious personal illness or family illness to contributors to the Bank who have exhausted their accumulated sick days and who are experiencing prolonged personal or family illness. Allotments will be limited to participating employees for use only in cases of illness, injury or nonelective surgery occurring under unusual, severe or emergency conditions as determined by the SBC. Members may enroll in the Sick Leave Bank during the month of October of each school year. Upon enrollment, a member shall contribute one (1) of his/her accumulated sick days to the Sick Leave Bank. Days contributed to the Sick Leave Bank are non-returnable. Enrollment in the Sick Leave Bank shall be continuous from year to year until a member withdraws provided the member has met the requirements of Section 2a. below. Withdrawals are accepted only during an enrollment period and only upon written notice by the member to the Sick Leave Bank Committee (SBC) of his/her intent to withdraw.
1. The Sick Leave Bank Committee shall be composed as follows:
a. The Superintendent or his designee.
b. Four members appointed by the ZEA president. The SBC shall review and approve or deny all applications to the Sick Leave Bank. The SBC shall also determine the necessity for additional contributions to the Bank and shall notify Bank members of the need for said contributions. The SBC shall be responsible for reporting data concerning the Sick Leave Bank to the treasurer. Decisions of the SBC are final. The SBC shall review the operation of the Sick Leave Bank annually, and shall make recommendations, if necessary, for modifications of the plan to the negotiating teams of the Association and the Board.
Xxxx Leave Bank. To provide Income Protection in the case of prolonged illness or disability, a "Sick Leave Bank" (SLB) will be established, effective July 1, 2003. The SLB will provide members with 100% compensation, for up to 12 months, dating from the first day of illness or disability. The SLB will be administered by the District in conjunction with this Association and the Bloomfield District Employee Association and Supervisors.
1. The SLB will be maintained as follows:
a. Initially, each participating unit member will contribute 2 days from their accumulated sick leave on July 1, 2003, to establish the SLB. Unit members will automatically be enrolled in the SLB. New employees will be given the option to enroll at hire.
b. A unit member choosing not to participate in the SLB must notify the District in writing by June 15, effective for the next school year. As a result, that unit member will receive no sick leave bank income protection from the District. If a unit member leaves the bank he or she cannot take the days out that he or she has donated. If such unit member wishes to participate in the SLB, he/she must notify the district in writing by June 15th, effective for the next school year.
c. The District will make an initial one-time contribution on July 1, 2003 to establish the SLB at one day per unit member participant.
d. Beginning July 1, 2004, the District will contribute up to 10 days per year to the SLB for each unit member who has reached their maximum sick leave days (200) to help maintain the SLB.
e. The SLB will be audited by May 30th each year to determine the status of accumulated sick days available to members. If the accumulated sick leave days available drops below 100 sick leave days, unit members will be notified and will contribute 1 additional sick leave day to replenish the SLB. Unit members not wishing to participate at that time must notify the District by June 30th of that year. The Association President and the Superintendent will review the status at other times in the event of an unanticipated deficit and may require an additional contribution to correct the deficit, subject to the unit member’s right to opt out of the SLB. If accumulated sick leave days are above 100 days no additional contributions will be necessary.
2. Use of the SLB will be permitted on the following terms:
a. A unit member must be a current contributing member to the SLB to participate.
b. A unit member must have used all of her/his accrued sick leave days.
c. A un...
