SAFETY AND EQUIPMENT. Section 1 The Board agrees to make provisions for the safety and health of its employees during the hours of their employment and to comply with applicable governmental regulations, requirements, and standards.

The Company shall make every effort to furnish and maintain safe working gear and equipment for the protection of its employees and shall continue to make reasonable provisions and rules for their safety. When a vessel is canalling, berthing or letting go, the Company agrees to use a Signalman in addition to the Winchman. The only exception to this is when mooring winches are side controlled.

Section 2 The provisions of this contract shall be applied to all employees covered by this Agreement without discrimination on account of sex, age, race, color, creed, national origin, religious or political affiliation, Association membership or activity.
Section 3 The Board agrees to provide employees with safety items required by law. The Board will not provide items of clothing or equipment which employees may wish for personal convenience. Should the Board require some item of dress, equipment, or safety equipment be used or worn as a condition of employment, the Board shall provide the item.
Section 4 The Board shall maintain a minimum of $5,000,000 public liability and personal damage insurance to protect employees.
Section 5 When a special education bus driver or bus attendant believes that the behavior of a special education student is a threat to the safety of him/herself, other students or an employee, the bus driver will complete the following procedure:
a) Fill out a discipline report;
b) Discuss the problem with the Transportation Director, and proceed to Step 3 below (or assist the Director in developing a different plan of action);
c) Along with the Transportation Director, discuss the problem with the student’s parent, teacher, and Special Education Director or designee. The purpose of these discussions is to identify potential safety issues pertaining to transportation of special education students and to develop plans to address such issues. At the end of thirty (30) calendar days or at any time the driver feels that the safety issue still exists, the driver may request another meeting pursuant to #2 above.
Section 6 Any case of assault upon an employee while at work shall be promptly reported to the administration. The administration will advise the employee of her/his rights and obligations with respect to such assault and shall promptly render all reasonable assistance to the employee in connection with handling of the incident by law enforcement and judicial authorities. Two (2) men shall be used for handling mooring lines at all times, one forward and one aft. When pulling long bow and xxxxx lines, two (2) men per line shall be used. Crew members required to work in cargo holds while unloading or loading operations are in progress, shall be under continuous surveillance by someone on deck. Members of the engine room shall not be required to work on staging or Xxxxx’s chair while the ship is under way. Crew members shall not be required to work on staging while the vessel is under way. Goggles, hard hats and respirators shall be signed for. suits which meet MOT standards shall be provided to all crew members on all vessels. It is understood that each unlicensed crew member shall be fully responsible and accountable for the suit at all times. If any of the above items are not returned at termination of employment, the Employee shall pay for the cost of replacement. During the hours of darkness outside painting must not be performed. First-aid kits, life preservers, life-jackets, portable life rafts, etc., shall not be stored away while on the run immediately prior to winter lay-up, nor shall the lifeboats be emptied of their equipment, permanently covered or securely lashed in preparation for such lay-up. It is agreed that any safety regulations that the Company may now have in force for the safety of the vessel and crew, and any further safety regulations which the Company shall put into effect and bring to the attention of the crew, shall be strictly adhered to by all crew members. It is recognized that with and it may be necessary for some hatches to be opened while the vessel is proceeding to a loading port and in transit when the routine cleaning of cargo compartments can be accomplished; however, due care and control must be exercised when engaged in this practice. SAFETY AND EQUIPMENT. The Company agrees to take every reasonable precaution to provide safe working conditions at all times and agree to have available on every tug and piece of dredging equipment ample first aid kits. These first aid kits to be checked at regular intervals and to be kept fully stocked. be strictly adhered to by all employees. Employees will co-operate in the maintenance of safe working conditions at all times by endeavouring to keep their working spaces clean and free of refuse and debris and in all other manners consistent with other safety practices. The Union agrees to co- operate fully in any safety programs the Company might initiate. The Company and the Union agree that a labour-management committee will convene for the purpose of drafting safety regulations which will be submitted to the parties concerned for their approval. When any safety regulations have been approved by the parties concerned, they shall be obligated to comply with them and these safety regulations shall be considered as an addendum or part of this agreement. The Company shall provide necessary safety equipment, other than personal wearing apparel, including hard hats, security belts, goggles when welding or chipping. Employees shall be held responsible for any such equipment supplied by the Company. When the said items are issued and not returned at the termination of employment, the employee to whom the items are issued will be held responsible and will have the cost of missing items deducted from any wages or monies owing him. Employees required to work from open boats and barges on buoys and runner lines shall be provided with vest-type jackets. At night, if necessary to clean scows, proper lighting must be provided for the safety of all employees. The Company agrees to arrange for adequate communication between units, vessels or equipment so as to any delay in case of emergency. The Company agrees to supply fans on each suction dredge where welding of pipes in confined areas is necessary so as to blow out any smoke when the pipes are being welded. Water from an approved source only shall be used for drinking or sanitary use. Employees who have been employed by the Company from dollars effective April This allowance shall be paid out at either the completion of the project or the end of whichever comes first, but shall only be paid out to a qualifying employee once per calendar year.
SAFETY AND EQUIPMENT. The Company will not require hourly employees to operate any company vehicle on the streets or highways that is not in safe operating condition or equipped with safety appliances prescribed by law. All unsafe vehicles shall be locked out and red tagged. The Company will not require hourly employees to operate any equipment that is in violation of any relevant statutes. It will not be a violation of this Agreement when hourly employees refuse to operate unsafe equipment or those not properly equipped as prescribed by law. The Company will not ask any hourly employee to take out a vehicle until same has been approved as being safe by the Company. In the event of a dispute over the condition of a vehicle, the matter shall be resolved after consultation between a member of Management, a Union Representative, and a certified mechanic. The certification as to the safety of the vehicle shall be in writing. Should said vehicle be certified by a mechanic as safe, then the employee who refused to take the vehicle out may be subject to discipline if, after the matter has been investigated by the Company and Union, the refusal was found to be frivolous.
a. Hourly employees will immediately, or at the end of their respective shifts, report all vehicle malfunctions and defects of equipment. b. Hourly employee operated Company vehicles will be equipped with a hand cart.
c. Maintenance of the equipment in good running condition is the duty and responsibility of the Company.
d. All Company vehicles will be equipped with adequate heaters, windshield wipers and defogger. These will be kept in good operating condition at all times. The driver's area will include a protective barrier between the driver and the freight.
e. Windshield washer solution and motor oil shall be made readily available at all times at the Company's expense for Company vehicles.
f. The Company must keep speedometers, odometers and fuel gauges in proper working order and reasonably accurate. Hourly employees held out of service during the investigation period relating to an accident in which that hourly employee was involved, will be paid for all time lost should it be found that the hourly employee was not at fault. SAFETY AND EQUIPMENT. SECTION 1: The purpose of this Section is to eliminate from use any vehicle or equipment that is dangerous to the operator or the public. No employee covered by this Agreement shall be required to operate any vehicle or equipment in an unsafe operating condition.
SECTION 2: City shall provide a protective vest for each permanent employee covered by this Agreement. Vest shall be worn at all times while on duty unless specifically waived by the Chief through policy implementation.

SAFETY AND EQUIPMENT. 10.1 The City shall provide and maintain safe, adequate and appropriate equipment sufficient for a specific job requirement it deems necessary for the performance of the police lieutenant’s function.
10.2 No employee shall be required to operate a marked passenger automobile or prisoner transport van which is not equipped with the manufacturer's police package including protection cages where feasible. Either portable or mounted spotlights will be provided on each such vehicle. All new marked vehicles will be equipped with bucket seats, mounted spotlights, power windows. After qualifying and purchase of approved shotgun or rifle, rifle or shotgun racks of a type approved by the City will be installed as determined by the Police Chief. 10.3 The City will make every reasonable effort to provide and maintain safe working conditions sufficient for a specific job requirement. To this end, the PBA will cooperate and encourage the employees to work in a safe manner and shall present recommendations through the Labor Management Committee.
10.4 The take home car program as it currently exists shall be a mandatory subject of bargaining. During the term of this agreement, City shall not remove the take home car program. Nothing contained herein shall interfere with any management rights set forth in this Agreement including, but not limited to, the City’s unilateral right to exercise control over its assets, assign work, and discipline its employees. The assignment of a take home car shall not be considered an economic benefit. Nothing contained herein shall effect SOP 609.1, as may be revised from time to time, subject to Article 8.5 and Article 42 of this Agreement.
10.4.1 The City shall provide an endorsement to its Certificate of Self Insurance or an insurance policy secured from a private insurance carrier to defend employees and pay any claims, judgements or awards for property damage and personal injury to third parties to the extent permitted by law resulting from the employee’s operation of an assigned vehicle as provided in 10.4 (above).
