JOB POSTING AND BIDDING. 10.1 When a new job is created or a job becomes vacant, the City agrees to post notice of the same on bulletin boards within fourteen (14) calendar days. Said notice shall be sent to all department heads and stewards at least one working day prior to the vacancy's posting date. Postings shall have a minimum duration of five (5) working days unless the City and the Union agree differently. Employees who are interested must make written application. Every effort will be made to fill said job or vacancy on the basis of seniority from the bargaining unit, if applicant has the necessary qualifications and experience to perform the duties.
10.2 The provision of this Article shall not apply to:
(a) Emergency positions.
(b) Student Intern, and other positions filled by students and/or trainees such as, Neighborhood Youth Corps, MDTA, Vocational Training and Cooperative Work Study Positions
(c) Positions not included within the bargaining unit.
(d) Positions accreted into the bargaining unit shall not require testing or posting.
10.3 In case of emergency, a City appointing authority may make an emergency appointment of any person to any position without regard to the provisions of this Agreement to carry on work that must be continued in the public interest, but no such emergency appointment shall continue for more than thirty (30) calendar days nor shall successive emergency appointments be made, and if a need exists for the position to continue beyond thirty (30) calendar days, the position shall be deemed vacant and posted in accordance with Section 1 of this Article. All such emergency appointments shall be reported to the Union within two (2) working days.
10.4 A vacancy will exist when there is a budget appropriation for the position, when no person holds or claims to hold the position, and when the appointing authority has established sufficient need and reason for the position to exist and has requisitioned that the position be filled. If a position which has been held by a member of the bargaining unit within the contract year is no longer held by such person and is not, within ten (10) calendar days, declared vacant by the City, the City shall so notify the Union.
10.5 The City agrees to furnish a copy of any job posting to the Union President for those jobs within the bargaining unit.
10.6 Employment and promotional lists for classified competitive positions shall be made available to the Union President.

JOB POSTING AND BIDDING. A. Notices of bargaining unit job vacancies, excluding temporary and on-call vacancies, shall be posted on the bulletin board at each facility for a period of three (3) business days prior to filling the vacancy. The Notice should include the job requirements specific to the position being posted. The full and complete minimum requirements for the position will be maintained by the personnel representative for disclosure to applicants at the time of bid.
B. Employees must bid within the three (3) day posting period in order to be considered for the vacant position. If an employee is absent from work during the three- (3) day posting period, the Union Xxxxxxx shall have the right to submit a bid on his/her behalf. In the event the employee will be absent for periods of up to 30 days, written job bids may be submitted in advance to the Personnel Department. However, the Employer shall not delay the selection process to accommodate absent employees. In the event an employee is going on vacation, a written job bid, to include, if possible, a telephone number where the employee can be reached, may be submitted to Personnel, and will remain active for the duration of the vacation.
C. Employees hired, promoted, or transferred into temporary jobs shall be eligible to bid on job vacancies only during the four (4) week period immediately prior to completion of their temporary assignment.
D. An employee shall not be allowed to bid for a position in a department where the Department Head, Physician Chief, Supervisor, or Assistant Supervisor is related to the employee, regardless of qualifications or seniority.
E. Upon ratification of this Agreement, and on an annual basis thereafter, employees shall have the right to submit an update of their educational background and/or other specialized knowledge that has been acquired. Such updates will be made a part of the employee's personnel file.
F. Employees shall not be eligible to transfer to another position within the bargaining unit until they have completed six (6) months in their current position, unless the transfer represents a promotion. An employee may transfer after three (3) months in their current position, only upon mutual agreement of the employee and the Employer.

JOB POSTING AND BIDDING. Section 21.1 The parties agree that all appointments to positions covered by this Agreement with the exception of original appointments shall be filled in accordance with this Article. Employees who fill vacancies pursuant to this Article shall not be required to undergo civil service testing and the Employer is not obligated to send employees for such testing.
Section 21.2 These provisions shall apply when a vacancy exists in the bargaining unit and the Employer intends to fill the vacancy. The Employer has the sole discretion to determine if a vacancy shall be filled. A vacancy is defined as an opening in a particular classification where the Employer has created a new classification or has increased the number of jobs in an existing classification, or where an opening occurs in a classification as the result of a promotion, transfer, quit, discharge or other termination of employment.
Section 21.3 The vacancy will be posted on the agency bulletin board for a period of seven (7) calendar days. Each vacancy notice will specify the job title, hours, location, pay range, program, job description, date of posting, qualifications and name of supervisor at the time of posting. Employees within the agency will have the first opportunity to fill such vacant position.
Section 21.4 The procedure contained in this Article shall apply to lateral transfers and to promotions. Lateral transfers are transfers from one classification to another classification when both classifications have the same pay range assignment.
Section 21.5 The Director shall select the most qualified employee for the vacant position based on the qualifications of the applicants as specified in the position description and shall consider requirements of the positions, seniority, experience, qualifications and training, the employee’s performance evaluations, relevant education, attendance (undocumented absences and/or patterned absences) and work history as documented in the personnel file and personal interview (if applicable).

When a position covered by this Agreement becomes vacant, such vacancy shall be posted except when a Supervisor is qualified for promotion in a manner consistent with the Town of Upton’s Personnel By-Laws. The position shall be awarded to the most reasonably qualified candidate whether due to an internal or external posting, consistent with the Town of Upton’s Personnel By-Laws in a conspicuous place listing the pay, duties, shift and qualifications. This notice of vacancy shall remain posted for seven (7) calendar days. Successful qualified internal D.P.W. Supervisors will be awarded the position over external applicants. Qualified external applicants, if successful, shall be given a six (6) month probationary period in the new position at the applicable rate.

When a position covered by this Agreement becomes vacant, as determined by the Town, such vacancy shall be posted in a conspicuous place listing the pay, duties, and qualifications. This notice of vacancy shall remain posted for seven (7) days. Employees interested shall apply in writing within the seven (7) day period. Within twenty-one (21) days of the expiration of the posting period, the Town Administrator will award the position to the most senior and qualified person for said position. The successful applicant shall be given a ninety (90) day trial period in the new position at the applicable rate of pay. If at the end of the trial and training period the Town Administrator determines that the employee is not qualified to perform the work, the employee shall be returned to his or her old position and rate. The Town shall notify the Union via fax or email of any new job postings which become available in the unit. Any successful internal candidate to a promotion shall have the right to self demote (request that he/she be returned to the position he/she occupied prior to being promoted) provided that self demotion can only occur during the probationary period for the position to which the employee was promoted.
JOB POSTING AND BIDDING. Section 1. When a vacancy occurs or a new position is created within the bargaining unit and the Employer determines to fill said vacancy or position, the vacancy will be posted electronically on the Franklin County Human Resources Career Page and advertised in local or other publications, at the discretion of the Employer. The vacancy will be posted for a minimum of eight (8) days. The first three days of the posting will consider lateral transfers within the same job classification, and the remaining five days will consider all other applicants. Lateral transfers will take precedence, and if approved, applications outside the job classification will not be considered. A non-probationary employee may bid on any posted vacancies for which they qualify. An employee may not bid for a lateral transfer or for promotion during their probationary period. Internal candidates must submit an application and a resume by the end of the posting deadline. All job postings shall be available through the Franklin County Human Resources Department website.
Section 2. Each posting shall indicate:

2. Salary
3. Minimum qualifications If there are changes in the posting prior to selection, the opening shall be reposted.
Section 3. All applications timely filed will be reviewed by the Employer for minimum qualifications. Applications will be reviewed to determine the most qualified applicant. The Employer shall be required to interview up to a maximum of four (4) internal applicants meeting the minimum qualifications. Applicants will not be denied an interview based on attendance. The Employer will select the most qualified applicant for the position based upon, but not limited to, the following criteria: the interview, demonstrated skill, work experience, education, work record, attendance (excluding approved family or medical leave under the Family and Medical Leave Act), active disciplinary records contained only in the employee's personnel file, and overall ability to perform the job responsibilities. If two or more internal applicants are determined to be equal for a given position, the applicant with the most seniority, as defined in Article 33, shall be selected. Such notification of vacancy shall be given to the union xxxxxxx at the time of the actual posting. This notice of vacancy shall remain posted for seven (7) calendar days. Employees interested shall apply in writing within the seven (7) calendar day period. Within fifteen (15) calendar days of the expiration of the posting period, the employer will award the position to the most senior applicant who is also a qualified and able applicant within the bargaining unit. In the event that there are no qualified bargaining unit members, or no bargaining unit members apply for the position, the employer may hire an applicant from outside the bargaining unit. An employee awarded a new position shall serve a three (3) month probationary period. Any prolonged absence from work may extend the probationary period at the Town Manager's discretion. Should the employee not successfully complete the probationary period in the sole determination of the Town, s/he shall be entitled to return to his/her former position. Should the employee return to his/her former position, he/she will have bumping rights in the event someone was hired to fill the position. The Town's decision concerning the employee's suitability for continued employment in the new position is not subject to the grievance and arbitration provisions of Article III. The parties agree that they shall comply with the provisions of the Americans with Disabilities Act when filling positions.
JOB POSTING AND BIDDING. In filling job vacancies which may exist within the bargaining unit, qualified employees from within the bargaining unit shall be given preference in filling said vacancies prior to the consideration of other applicants. Seniority shall be the determining factor in filling vacancies when the Employer determines that the senior employee is qualified and has the ability to perform the job. Such determination shall not be arbitrary or capricious. All job openings must be posted for a period of no less than seven (7) calendar days in all outlets. Job postings shall list the scheduled days and hours of work for this opening. If a qualified senior employee bids from within the bargaining unit, the Employer shall award the bid to that employee within fourteen (14) calendar days of the initial job posting date. Permanent job vacancies, including jobs in new or remodeled units, shall be awarded to the most senior employee who submits a bid based on Classification seniority, in the following order of priority:
1) within the concept
2) within the bargaining unit
3) laid-off employee (if any exist at the time of the bid. Vacancies not filled within a Classification will be awarded to the most senior qualified employee (based on Company seniority) who submits a bid, in the following order of priority:
