- SICK LEAVE, SICK LEAVE BANK. 15.01 Each Member covered by this Agreement shall be credited with ten and one-half (10½) hours of accumulated sick leave for every month of continuous service.
15.02 Any Member who is off on paid sick leave shall, nevertheless, be deemed to be on continuous service for the purpose of this Article only.
15.03 The hours of unused sick leave shall be accumulated.
15.04 A current account of hours standing to a Member's credit will be distributed annually.
15.05 Each Member covered by this Agreement with less than five (5) years continuous service and having accumulated sick leave who retires at normal retirement date, or after any extension thereof, or who is dismissed by reason of ill health, or resigns for reasons of ill health as certified by the Board's physician in consultation with the Member's physician, shall be granted a leave with pay at the current rate of pay for one-half (½) the number of hours then standing to their sick leave credit, but payment for such leave shall not exceed one-half (½) of their yearly salary at the current rate of pay.
15.06 After completing five (5) years of continuous service, each Member covered by this Agreement, upon their resignation, shall be granted one- half (½) of their accumulated sick leave at their current rate of pay. The pay shall not in any event exceed one-half (½) of their current yearly salary. The accumulated sick leave payout will not apply to Members hired after date of ratification.
15.07 In the case of the death of the Member the payment will be made to their estate.
15.08 A Member who is off work because of illness or non-compensable injury will receive full pay on an hour for hour basis to the extent of their unused credits.
15.09 The current hourly rate of pay mentioned in the provisions of this Article of the Agreement shall be computed by dividing the amount of the Member's yearly salary in effect at the date of their retirement or resignation by one thousand eight hundred and twenty (1820).
15.10 Each Member of the Association shall contribute one (1) day of their accumulated sick leave to a Central Sick Leave Bank and shall give additional days as required. The number of accumulated sick leave days contributed by a Member to the Central Sick Leave Bank shall not exceed one-half (½) day per month or six (6) days in a given year, thereby allowing a Member to retain a minimum of one (1) day per month for the Member's own personal use. - SICK LEAVE, SICK LEAVE BANK. A. Sick leave will be used for personal illness or medical treatment except as otherwise noted in the contract.
B. All teachers will be entitled to fifteen (15) days sick leave each school year. Part time teachers employed by the district will be eligible to receive prorated benefits. Unused sick leave may be accumulated from year to year to a total of one hundred fifty (150) days. A teacher reaching the maximum sick leave will receive fifteen (15) non-accumulating days. Family Care leave and FMLA leave will run concurrently if applicable.
C. Sick leave time used will be recorded in half-day increments.
D. In cases of extended illness (five [5] or more days) the Superintendent may request a statement from a duly licensed physician substantiating a claim for sick leave before honoring such claim. If such a statement is not present within ten (10) days of the request, the claim will be disallowed.
- SICK LEAVE, SICK LEAVE BANK. Bargaining unit members shall receive accumulative and non-accumulative sick leave in accordance with campus policies for employees holding temporary assignments. Bargaining unit employees are also extended the opportunity to participate in the applicable sick leave bank option in accordance with campus policies for employees holding temporary assignments. Any cap on sick leave accumulated by Instructors in accordance with this section shall not be less than 75 days for the duration of the agreement. Eligible bargaining unit members shall also be granted benefits and entitlements established under the Family and Medical Leave Act of 1993 as amended in accordance with University policies. Additionally, bargaining unit members shall be eligible for disability benefits as provided by the State Universities Retirement System and subject to applicable limitation policies and procedures. If an employee has accrued cumulative sick leave and moves into a position in which sick leave is not accrued, that employee’s accrued cumulative sick leave will be maintained on the University’s records until:
a. the employee moves into a position in which sick leave may be accrued, at which point the employee shall be credited with previously accrued sick leave days, or
b. until the employee leaves the employment of the University, at which point an employee shall be entitled to a lump sum payment or service credit in accordance with SURS policies.
- SICK LEAVE, SICK LEAVE BANK. 1. Teachers shall be allowed to use accumulated sick leave, without loss of pay, for absences from regularly contracted teaching duty due to personal or family illness or physical disability. The District may also discuss the use of sick time with a teacher if necessary. In these instances, the teacher may exercise their Xxxxxxxxxx rights. Teachers contracted for the summer months shall earn and be entitled to use accumulated sick leave benefits. (2019)
2. Any absence by a teacher resulting from bodily injuries suffered directly from an assault on a teacher while performing contracted duties in accordance with Board policies and state statutes will not be deducted from the teacher's contracted salary for a total of 60 absences from work, if related to the injury. Administration may require documentation. The value of all benefits paid to the teacher during this period from all other eligible sources shall be deducted from contracted salary and benefits or repaid to the Board upon receipt. The assault shall be immediately reported to the building administrator and central administration, and a formal complaint may be filed with the proper legal authorities. Any benefits inappropriately paid under this provision shall be repaid to the Board, and the Board's cost of collection shall, if overpayment was caused by teacher action or inaction, be added to the cost of reimbursement. 3. Each teacher will be credited with twelve (12) days of sick leave on the first contracted day of the school year. The teacher who does not complete contract obligations will be liable to the district for sick leave paid beyond the employee's entitlement. Employment for less than 187 full-time duty days or employment for more than 187 full-time duty days shall earn or accrue sick leave on a proportionate basis to the 187 full-time duty day contract. Bargaining unit members with compensable sick leave balance (sick leave earned prior to December 31, 1997) will be paid half of the balance at the time of separation and the other half will be reported to SURS for service credit in accordance with SURS policies.
- SICK LEAVE, SICK LEAVE BANK. 1. Each teacher shall be provided ten (10) days of sick leave each school year. For teachers who obtain employment with the district after the school year has begun, the sick leave will be prorated. Sick leave shall be vested in full on the teacher's first workday.
2. Sick leave may be used for personal accidental injury, illness or pregnancy or the accidental injury, physical or mental illness or death of a relative or any member of the employee's household. Relative of employee means spouse, child, stepchild, grandchild, grandparent, stepparent or parent of the employee. Member of employee's household means those persons who reside in the same home such as xxxxxx children or legal wards, excluding tenants.
3. Whenever an absence extends beyond three (3) consecutive days, and when abuse is suspected by an administrator, a teacher may be required to provide appropriate evidence that the absence was necessitated by reasons allowable under the provisions of this agreement.
4. Leave benefits will be calculated in one-quarter day segments. The schedule for licensed/certified personnel is as follows: 1/4 day = more than 0 hours up to 2 hours 1/2 day = more than 2 hours up to 4 hours 3/4 days = more than 4 hours up to 6 hours Full day = more than 6 hours up to 8 hours 10 minutes 5. FMLA runs concurrently with personal leave. (FMLA does not increase amount of leave).
- SICK LEAVE, SICK LEAVE BANK. 1. Each teacher shall be entitled to fifteen (15) sick leave days per school year, cumulative to a maximum of two hundred and twenty (220) days. In the event that a teacher who is not working on the first day of the school year does not return to work during that school year, the Board shall be entitled to deduct from the sick leave bank the number of days granted to the teacher for that year. The teacher's available sick leave balance will remain unchanged. [Note: Any teacher who has more than 220 days at the end of the 1998-99 school year shall have those days protected and shall not be credited with any additional days until such time as the teacher's accumulated sick leave days fall below 220 days as of the beginning of a school year.]
- SICK LEAVE, SICK LEAVE BANK. 12.2.1 Full-time regular unit members shall be credited with twelve (12) days of sick leave per fiscal year.
12.2.2 Sick leave will be credited as of July 1, of each fiscal year.
12.2.3 Unused sick leave may be accrued from one year to the next.
12.2.4 Sick leave utilization shall be for physical and mental disability absence which make continued employment impractical.
12.2.5 The District may require certification from a physician of other proof of illness for days of absence due to illness or accident. Certification or proof may be required only when the absence exceeds five (5) consecutive work days or when there has been specific indication that sick leave has been abused. The District may also require the unit member to visit a physician of the District’s selection at the District expense to obtain a statement of verification relative to the unit member’s ability to fulfill their responsibilities in a safe, healthful and satisfactory manner.
12.2.6 Unit members are entitled to extended sick leave after exhausting all earned sick leave at full pay and they continue to be absent due to illness or injury. During the period of the extended sick leave, a unit member shall receive that amount of pay equal to fifty percent (50%) of the unit member’s regular contract salary for a maximum of one hundred (100) days, exclusive of the current year’s sick leave credit (12.2.1), but inclusive of up to twenty-five (25) days of accrued sick leave (12.

F. A teacher’s accumulated sick leave will be included on the advice slip sent each pay period.
G. At the beginning of each school year, a teacher may contribute one (1) day of their sick leave allowance to a common sick bank to be administered by the Superintendent. It will be the responsibility of the Superintendent to notify the Sick Leave Bank Committee of each request and each withdrawal from the sick bank as each occurs.
H. To be eligible for the sick bank, a teacher must give one (1) of their sick days at the beginning of each contract year. Unless a teacher provides written notice to the Superintendent within fifteen (15) days from the beginning of their work year or from the teacher’s date of hire, one (1) sick leave day will automatically be deducted from their sick leave and given to the sick leave bank.
I. Teachers who have exhausted their accumulated personal sick leave allowance may make reasonable withdrawals from the sick bank as determined by the Sick Leave Bank Committee and the Superintendent, not to exceed sixty (60) days in any given school year. Additional days may be granted from the bank under unusual circumstances at the Superintendent's sole discretion. In September of each year, the bank will carry a maximum of three hundred (300) days.
