JOB POSTING AND BIDDING. A. Notices of bargaining unit job vacancies, excluding temporary and on-call vacancies, shall be posted on the bulletin board at each facility for a period of three (3) business days prior to filling the vacancy. The Notice should include the job requirements specific to the position being posted. The full and complete minimum requirements for the position will be maintained by the personnel representative for disclosure to applicants at the time of bid.
JOB POSTING AND BIDDING. When a position covered by this Agreement becomes vacant, such vacancy shall be posted except when a Supervisor is qualified for promotion in a manner consistent with the Town of Upton’s Personnel By-Laws. The position shall be awarded to the most reasonably qualified candidate whether due to an internal or external posting, consistent with the Town of Upton’s Personnel By-Laws in a conspicuous place listing the pay, duties, shift and qualifications. This notice of vacancy shall remain posted for seven (7) calendar days. Successful qualified internal D.P.W. Supervisors will be awarded the position over external applicants. Qualified external applicants, if successful, shall be given a six (6) month probationary period in the new position at the applicable rate.

When a position covered by this Agreement becomes vacant, such vacancy shall be posted in a conspicuous place listing the pay, duties and qualifications, number of hours, shift (if applicable), and whether the position is full-time or part-time. Such notification of vacancy shall be given to the union xxxxxxx at the time of the actual posting. This notice of vacancy shall remain posted for seven (7) calendar days. Employees interested shall apply in writing within the seven (7) calendar day period. Within fifteen (15) calendar days of the expiration of the posting period, the employer will award the position to the most senior applicant who is also a qualified and able applicant within the bargaining unit. In the event that there are no qualified bargaining unit members, or no bargaining unit members apply for the position, the employer may hire an applicant from outside the bargaining unit. An employee awarded a new position shall serve a three (3) month probationary period. Any prolonged absence from work may extend the probationary period at the Town Manager's discretion. Should the employee not successfully complete the probationary period in the sole determination of the Town, s/he shall be entitled to return to his/her former position. Should the employee return to his/her former position, he/she will have bumping rights in the event someone was hired to fill the position. The Town's decision concerning the employee's suitability for continued employment in the new position is not subject to the grievance and arbitration provisions of Article III. The parties agree that they shall comply with the provisions of the Americans with Disabilities Act when filling positions.

Section 21.1 The parties agree that all appointments to positions covered by this Agreement with the exception of original appointments shall be filled in accordance with this Article. Employees who fill vacancies pursuant to this Article shall not be required to undergo civil service testing and the Employer is not obligated to send employees for such testing.

Within twenty-one (21) days of the expiration of the posting period, the Town Administrator will award the position to the most senior and qualified person for said position. The successful applicant shall be given a ninety (90) day trial period in the new position at the applicable rate of pay. If at the end of the trial and training period the Town Administrator determines that the employee is not qualified to perform the work, the employee shall be returned to his or her old position and rate. The Town shall notify the Union via fax or email of any new job postings which become available in the unit. Any successful internal candidate to a promotion shall have the right to self demote (request that he/she be returned to the position he/she occupied prior to being promoted) provided that self demotion can only occur during the probationary period for the position to which the employee was promoted.
JOB POSTING AND BIDDING. 10.1 When a new job is created or a job becomes vacant, the City agrees to post notice of the same on bulletin boards within fourteen (14) calendar days. Said notice shall be sent to all department heads and stewards at least one working day prior to the vacancy's posting date. Postings shall have a minimum duration of five (5) working days unless the City and the Union agree differently. Employees who are interested must make written application. Every effort will be made to fill said job or vacancy on the basis of seniority from the bargaining unit, if applicant has the necessary qualifications and experience to perform the duties.

In filling job vacancies which may exist within the bargaining unit, qualified employees from within the bargaining unit shall be given preference in filling said vacancies prior to the consideration of other applicants. Seniority shall be the determining factor in filling vacancies when the Employer determines that the senior employee is qualified and has the ability to perform the job. Such determination shall not be arbitrary or capricious. All job openings must be posted for a period of no less than seven (7) calendar days in all outlets. Job postings shall list the scheduled days and hours of work for this opening. If a qualified senior employee bids from within the bargaining unit, the Employer shall award the bid to that employee within fourteen (14) calendar days of the initial job posting date. Permanent job vacancies, including jobs in new or remodeled units, shall be awarded to the most senior employee who submits a bid based on Classification seniority, in the following order of priority:

Local 1451 employees interested in being considered for a vacancy shall apply in writing within the above-referred 10 day posting period. It is understood that the Town will first interview clerical chapter employees who apply before interviewing other Local 1451 covered position employees and applicants from outside the bargaining unit.
