ASSOCIATION AND EMPLOYEE RIGHTS. A. The Association shall have the right to use Xxxxxxx school buildings and facilities provided such usage does not interfere with District operations. Requests will be submitted through the procedures established by the District and are subject to the provisions of Board Policy. Any costs above and beyond the building usage policy incurred through such usage shall be assumed by the Association. B. The Association shall have the right to use District equipment (including copy machines, audio visual equipment, etc.) with the approval of the Superintendent or his/her designee. Any costs of materials incurred in such usage shall be assumed by the Association. Employees will also be provided all materials necessary to perform their expected duties. C. Where possible, bulletin boards and mailboxes shall be made available to the Association and bargaining unit members in each building that bargaining unit members are assigned to. D. Duly authorized representatives of the Association shall be permitted to transact official business on school property, provided that such business shall not interfere with normal operations. Representatives of the Association not employed by the District shall notify the supervisor of the affected employees of their presence. E. The Association may request the Board place items of interest to it on the Board agenda. These items must be filed with the Superintendent one (1) week before each regular Board meeting, unless agreed otherwise by the Superintendent or his/her designee. F. Upon request, the Superintendent and/or his/her designee shall meet with Association representatives, at agreed upon times, to discuss problems and concerns. At the request of the Association, at least one meeting shall be held each year. G. The Board shall make lunchroom space available when possible, and lavatory facilities in each building where bargaining unit employees are assigned. H. Telephone facilities shall be made available for staff use. Phone usage shall be for school-oriented business and/or personal business that cannot be conducted at another time. Unless the call is made collect or on the employee's telephone credit card, no long distance calls are permitted without supervisory approval. I. Existing parking facilities shall be made available to bargaining unit members for their use. J. ASSOCIATION AND EMPLOYEE RIGHTS. X. Xxxxxxxx to the Public Employment Relations Act, the Board agrees that every employee within this bargaining unit has the right to fully organize, join and support the Association for the purpose of engaging in collective bargaining or negotiation and other lawful activities for mutual aid and protection. As a duly elected body exercising governmental power provided by law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any employee in the enjoyment of any right conferred by law. The Board will not discriminate against any employee with respect to hours, wages, or any terms or conditions of employment by reason of membership or non-membership in the Association, participation in any lawful activities of the Association or collective professional negotiations with the Board, or institution of any grievance, complaint or proceeding under this Agreement with respect to any terms or conditions of employment. The Board and the Association agree that neither will discriminate against any employee because of his/her race, age, sex, creed, religion, marital status or disability. B. Nothing contained herein shall be construed to deny any right an employee may have under the Michigan Revised School Code or other applicable laws or regulations nor shall anything contained herein be construed to allow any right an employee is denied under such laws or regulations. C. The Association and its representatives may use school buildings for meeting purposes as per Board policy. Scheduling and reimbursement for expenses shall be in accordance with Board policy. D. In the event the Administration identifies a specific school for school improvement under 20 USC 6316 (b) paragraphs (1) or (5), or for corrective action under paragraph (7), or for restructuring under paragraph (8), the Administration shall notify the Association Representative(s) in the specific school. X. Xxxx authorized representatives of the Association and their respective affiliates shall be permitted to transact official Association business on school property at all times, provided that this shall not interfere with nor interrupt student instruction or counseling or other educational activities. ASSOCIATION AND EMPLOYEE RIGHTS. A. The exclusive Representative ("Association") shall have the right to represent its members in employment relations with the District. B. The Association shall have the right of access at reasonable times to areas in which employees work, the right to use bulletin boards, mail boxes, and other means of communication and office equipment subject to reasonable regulations, and the right to use district facilities at reasonable times for the purposes of meetings concerned with the rights guaranteed in this Agreement. C. The Board and Association recognize the right of employees to form, join, and participate in lawful activities of employee organizations . D. Within a reasonable period of time, and subject to the workload of district staff, the Association shall be provided upon request any and all information, statistics, and records which the Association may deem relevant to negotiations, or necessary for the enforcement of this Agreement. E. A reasonable number of representatives of the Association shall have the right to receive reasonable periods of released time without loss of compensation when meeting and negotiating and for the processing of grievances.

The Association, a private organization, shall have the same right to use the school buildings as any other community organization. D. The Association, a private organization, shall have the same right to use the school facilities as any other community organization. E. The Association shall have the right to post notices of activities and matters of the Association on the appropriate and specifically assigned bulletin board. Where a bulletin board is not already provided, the Association will provide one at its expense. The school principal shall determine location of the bulletin board in each school. The Association may have the right to use the employee school mailboxes for the purpose of distributing Association material relating to Association business to employees. X. Xxxx authorized representatives of the Association may be permitted to transact official Association business on school property provided that this shall not interfere with or disrupt school operations and has received the permission of the school principal. G. The Board agrees to furnish at actual cost of reproduction (including material and labor) to the Association those items, used in routine operation, which are considered, according to law, public records. ASSOCIATION AND EMPLOYEE RIGHTS. A. The Board hereby agrees that members of the bargaining unit are accorded all the rights, privileges, and duties conferred by applicable laws of the State of Michigan as well as the Constitutions of the State of Michigan and of the United States. The parties further agree that alleged violation of such laws or Constitutional provisions shall not be processed through the final step of the grievance procedure found in this Agreement. B. The Association may request the use of school building facilities for its meetings through the Superintendent or his/her designated representative. These requests must be in writing and submitted at least twenty-four (24) hours in advance of the proposed meeting. The request is subject to the approval of the Superintendent or his/her designee. The Association shall reimburse the District for all costs associated with the use of such facilities in accordance with the Board of Education policy as applied to other school affiliated groups. C. No Bargaining Unit Member shall be prevented from wearing insignia, pins or other identification of membership in the Association, either on or off school premises, provided that such activities do not impair the performance of work or create disruptive conditions within the school. D. Space shall be made available for the Association on a bulletin board in each school building where Bargaining Unit Members work for the posting of notices by the Association regarding Association business and matters of interest related to the Association which are not disruptive and do not interfere with the work of Bargaining Unit Members. The Association assumes responsibility for materials placed on such bulletin boards by the Association and its authorized agents. E. When requested by the Association, the Board agrees to make available public budgetary information and other public information which may be necessary for the Association to bargain collectively. Further, the Board agrees to provide the Association with any information which may be relevant and necessary to process a grievance, provided the information is not exempted from disclosure by law.

The Board recognizes and respects the right of citizens to make suggestions for the improvements of public schools but maintains that no group can deny academic freedom to educators. The Board recognizes that the education profession has both the right and the responsibility to insist that children must be free to learn broad areas of knowledge, including those considered controversial. Thus, no special limitations shall be placed upon study, investigation, presentation, and interpretation of facts and ideas, except that: 1. The employee must exercise responsibility and prudence and must realize that working in an elementary or secondary school places special responsibility upon the employee to carefully consider the maturity level of the student and the special circumstances that surround the teacher/learning relationship. 2. The employee shall have the responsibility of keeping the principal informed of all controversial issues to be taught outside the accepted course of study. If any group or individual brings charges against the employee designed to impede the employee’s freedom to teach, and the employee’s position concurs with the Board of Education Policy, and numbers 1 and 2 above, the Board shall provide without cost to the employee the necessary and sufficient leave of absence, legal assistance, and other support for the protection of academic freedom. Any amendment to Policy will be distributed by the Board to each teacher. E. 1. PUBLIC ACT 379 The Board and the Association agree to abide by Act 379 of Public Acts of Michigan for 1965 and all amendments thereto and to all applicable laws and statutes pertaining to employee’s rights and responsibilities. The Board further agrees that it shall not directly or indirectly discourage or deprive or coerce any employee in the enjoyment of their rights granted to them under the laws above stated. B. BUILDING USE 1. The Local Association and its members shall have the right to use the school building facilities before or after regular hours and during lunch periods. Such use of the building for Local Association meetings must be arranged with the building principal in advance. The principal retains the right of room assignment. 2. The Association shall have the right to use the District inter-office shuttle mail service for official Association business, for delivering materials between Kentwood School buildings. The service is available only on days that the shuttle is scheduled by the administration. The Association may also use fax machines and E-mail systems, which are available to bargaining unit members at reasonable times and hours, to communicate with its general membership relating to official Association business, provided the equipment is not otherwise in use. The Association’s use of e-mail will comply with all applicable laws and Board policies. The Association shall furnish all materials and supplies incidental to its operation of Board equipment. The Association will pay for toll and long distance charges incurred by its use of District telephones. Materials transmitted by the school fax machine and e-mail shall identify the Association as the transmitter. Copies of all postings must be provided to the Executive Director for Human Resources. 3. Any Association officer or representative from outside the building must first make presence known in the principal’s office before conducting Association business in buildings within the district.
