General Overtime Provisions. A. Overtime shall not be distributed or withheld as a reward or penalty. B. When an employee, whether covered by the Fair Labor Standards Act or exempt, works regular overtime, such overtime will be scheduled and paid in increments of 15 minutes. When an employee, whether covered by the Fair Labor Standards Act or exempt, works irregular overtime, such overtime will be paid in increments of 15 minutes. Daily increments of less than 15 minutes, if such occur, will be accumulated during the workweek. At the end of the workweek, any increments of 7 minutes or fewer will be rounded down and any increments of 8 minutes or more will be rounded up to the next 15 minute interval. C. Employees covered by both the Fair Labor Standards Act and Title 5 U.S.C. shall receive overtime compensation in accordance with whichever benefit is greater. D. When approved by Management, employees can accrue and use compensatory time in accordance with applicable law and Government-wide rule and regulation. When feasible, the Employer shall grant such an employee's request for compensatory time rather than payment for overtime. An employee may request compensatory time off for hours of work spent in travel status that otherwise would qualify for overtime compensation, in accordance with law, government-wide regulation and Agency policy. E. When employees in a voluntary situation indicate in advance that they will work overtime, the Employer should have a reasonable expectation that they will keep their commitment. It is understood that employees occasionally may be unable to report for assigned overtime work. Therefore, an employee who volunteers for overtime work and fails to report as scheduled without good cause may have his or her name placed at the end of any overtime roster. Such employees may be considered for overtime after all eligible employees have been given proper consideration or will be excluded from overtime work for two (2) weeks, whichever comes first. F. Employees who are called back to work at the office for a period of overtime unconnected to their regularly scheduled tour, or who work overtime on Saturday and/or Sunday but are unable to complete the minimum overtime scheduled due to work related reasons outside control of the employee, are entitled to a minimum of two hours of overtime pay. General Overtime Provisions a. Employees covered (non-exempt) under the Fair Labor Standards Act (FLSA): 1. Employees who work in excess of their regularly scheduled hours per day, week, or pay period with the knowledge (direct or indirect) of their supervisors (suffered and permitted), will be compensated for that overtime worked. 2. Employees are entitled to monetary compensation at one and one-half (1 ½) times the basic rate of pay unless they make a written election to take compensatory time off instead. 3. Prevailing Rate System (i.e., wage grade) employees, covered by the Fair Labor Standards Act (FLSA), may earn compensatory time-off in lieu of overtime payment. Employees must request compensatory time in writing prior to working the overtime. b. Employees not covered (exempt) under the FLSA: 1. For each employee whose rate of basic pay does not exceed the minimum rate for GS-10, the overtime hourly rate is 1 ½ times his or her hourly rate of basic pay. 2. For each employee whose rate of basic pay exceeds the minimum rate for GS-10, the overtime hourly rate is 1 ½ times the hourly rate of basic pay at the minimum rate for GS-10. 3. Employees may request to receive either overtime payment or compensatory time off. However, employees whose rate of pay exceeds GS-10, Step 10, may be required to take compensatory time off in lieu of overtime pay. c. Supervisors will provide sufficient opportunities for Employees to use compensatory time within workload and staffing requirements.

This does not apply to employees off work on vacation. (b) An employee who is on light duty will be eligible for overtime. (d) Where the reference to classification is identified throughout Article 8:05 a), b) c); it shall mean group for the HF Production. (e) Overtime hours are defined in 8:02 and 8:03. (f) In recording overtime opportunities, the Company will follow the Union's request that overtime offered or worked including call-in allowance be charged to an equivalent straight time hour amount. A record of overtime will be posted in all departments and updated weekly. Overtime equalization will apply to all job classifications. End of year overtime averages will be reflected in new year starting averages. At anytime the overtime average are equal opportunities will be offered based on seniority. (g) The Company will continue a policy of excusing a person from overtime work (this includes emergencies) so long as others are willing to work and excusing a person in any event when he has a reasonable excuse. (h) No provision of this agreement shall entitle an employee to more than one premium payment for the same hours worked. (i) Employees will have the option of banking their overtime hours and taking the time (converted to the applicable straight time hourly rate at the time in which the overtime was worked) off at a mutually agreed date within the calendar year to a maximum of eighty (80) hours. It is agreed that a request for a vacation day will be guaranteed prior to granting banked overtime and approval provisions for the use of banked overtime will be subject to the two week advance approval process as outlined in Article 20:00 and at all times will be subject to operating conditions. General Overtime Provisions. A. Overtime is distributed in a fair and equitable manner. B. When an employee works overtime, whether exempt or non-exempt from the Fair Labor Standards Act (FLSA), such overtime is paid as authorized by applicable regulation. C. Employees are paid differential and premium pay in addition to the overtime compensation in accordance with applicable regulation. D. When employees commit to work overtime, it is expected that they report for duty as required. If an employee is unable to report for assigned overtime work, they must call their supervisor prior to the start of the tour of duty with a reasonable explanation as to why they cannot report. E. Employees who are called back to work for a period of overtime unconnected to their regularly scheduled tour of duty are entitled to a minimum of two (2) hours overtime pay or compensatory time. F. Overtime work schedules are maintained and available to the Union, upon request. The retention period is three (3) years. G. In the event of an extension of a regular work shift into a day, evening, or night work shift for more than a three (3) hour overtime work period, a non-paid break of up to one (1) hour is allowed no later than three (3) hours after the overtime starts, unless the emergency situation precludes it. H. Issues concerning overtime should be raised as soon as practicable.

F. In accordance with regulations, supervisors will not require employees to earn compensatory time in lieu of overtime pay. G. The Agency shall, to the extent practicable, permit employees to use their compensatory time at the earliest time convenient to them within twenty-six (26) pay periods. H. Normally, compensatory time off shall be granted before annual leave is approved. If annual leave would otherwise be forfeited, the annual leave shall be granted before compensatory time. Any employee who is unable to use compensatory time within twenty-six (26) pay periods shall receive overtime pay instead. However, earned compensatory time off for travel will be forfeited if not used within 26 pay periods in accordance with OPM regulations.

General Overtime Provisions. Subject to and consistent with all federal laws, including but not limited to the Fair Labor Standards Act of 1938, as amended (29 USC 201, et seq.), the Federal Employees Pay Act (5 CFR Part 550, Part 551) and 38 USC 7422, 38 USC 7453, and 38 USC 7459. Consistent with law and VA regulations this article does not apply to physicians, dentists, podiatrists, chiropractors and optometrists. The Department reserves the right to determine the qualifications required to work overtime. The Department will determine the number of employees needed to work overtime. If the Department requires overtime, employees are entitled to receive overtime pay. Overtime work shall be paid in accordance with applicable laws and regulations including, but not limited to, 5 CFR Part 551,Sub-part E. The purpose of this Article is to establish a process for the distribution of overtime that is fair and equitable. When making determinations on overtime assignments, the Department will give consideration to such factors as the character of the work, qualifications or professional competencies (as determined by the Department), availability and organizational location of employees, knowledge of the particular type of work involved and health/fatigue limitations. Employees shall be paid differential and premium pay in addition to the overtime compensation in accordance with applicable laws and regulations. It is agreed that non-bargaining unit employees shall not be scheduled on overtime to perform the duties of bargaining unit employees for the sole purpose of eliminating the need to schedule bargaining unit employees for overtime. The Department shall make a reasonable effort to give the employee as much notice as possible when planned overtime is required. If an employee is mandated to work overtime and has a conflict regarding the mandated overtime, the Department will give due consideration to the employee’s personal circumstances subject to the paramount requirement of fulfilling the mission of the Department. At the employee’s request, the Department will endeavor to avoid mandated overtime exceeding four hours at the end of the employee’s tour of duty. When the Department mandates unplanned overtime, employees are expected to work overtime. If an employee is mandated unplanned overtime, an employee may request release from an overtime assignment.
