The PGSF will improve Puget Sound water quality by reducing combined sewer overflows (CSO) and providing regional stormwater treatment. To support that work, a series of conveyance projects must be built to convey and discharge flows to and from the PGSF. This scope of work is to design the required improvements identified in the Port Xxxxxxx Storage Facility Engineering Report, HDR and Brown and Xxxxxxxx, August 18, 2021, including: CO-1, CO-2, CO- 3 (including replacement of the downstream discharge structure), CO-8, CO-9, CO-10, CO-11, CO-19, CO-20, CO-28, CO-33. In addition, four stormwater pretreatment units are to be provided. CO-2, CO-8, CO-9, CO-10, CO11, CO-19, CO-20, CO-28, and CO-33 are required to be complete and operational by the end of 2027 per the Agreed Order. Service Provider will be expected to provide emergency service at any time to investigate an occurrence which may have liability implications for the City. Such duties shall include the following: • Receive notice of and create files on each claim submitted to Service Provider by the City Attorney’s Office and maintain these files for the City. Each claim file shall be maintained on a current basis to reflect summary of investigation, witness names and addresses, liabilities, exposure, and recommended disposition; • Investigate all claims submitted by the City Attorney’s Office to determine liability and estimated settlement value; • Request timely payments of claims, in accordance with settlement and payment procedures as established by the City Attorney’s Office. The City will be solely responsible for providing payment as may be required for any claims assessed against it; • Prepare documentation and defense of cases, and assist assigned legal counsel in preparation of cases for litigation; and • Maintain and provide the City pertinent data on all claims payments.
