Sick Leave and Disability Benefits. 10.3.1 The Employer shall implement a single plan for the provision of disability benefits for eligible employees who are covered by this Agreement. 10.3.2 As per Article 9.3 of the 2019-2022 Common Agreement, the insured plan has the following elements: (a) Benefit level of sick leave at one hundred percent (100%) for the first thirty (30) calendar days, short-term disability at seventy percent (70%) weekly indemnity for the next twenty one (21) weeks, and long- term disability leave of seventy percent (70%) thereafter; (b) Long-term disability as defined on the basis of two-year own occupation and any other occupation thereafter as described by the JCBA plan; (c) Health and welfare benefit premiums will be paid by the Employer or the Plan for employees on sick leave, short-term disability and long- term disability; (d) Employer payment of premiums for both short-term and long-term disability benefits; (e) Claims Review Committee made up of three (3) medical doctors (one designated by the claimant, one by the Employer and the third agreed to by the first two doctors); NIC/NICFA Collective Agreement 44 (f) Mandatory rehabilitation as described in the JCBA plan; (g) Subject to provisions of the Plan, enrolment is mandatory for all active regular employees and for active non-regular employees employed on a continuing basis for at least a four (4) month period with fifty percent (50%) or more of a full-time workload as defined by local provisions of Article 10.3.3.

Sick Leave and Disability Benefits. 15.01 Members shall be entitled to leave from employment while disabled from performing the duties of their employment because of personal illness or accident subject to the limitations of this article and any modified or accommodated work that may be offered by the board. 15.02 The employer shall pay the premiums on a Short and Long Term Disability Policy from Mutual Life or a carrier mutually agreed to by the parties, providing a weekly indemnity to all members disabled by illness or accident and prevented from performing the duties of their own occupation. The Short Term Disability policy shall commence after fourteen (14) days of continuous disability by illness or accident, and continue on for a maximum benefit period of fifteen (15) weeks.. The Long Term Disability Policy shall commence upon expiry of the Short Term Disability Policy and shall continue for twenty four (24) month period and then afterwards when the member is unable to perform any gainful employment for which the member is reasonably suited by education, training or experience. The disability benefit so provided shall be in an amount together with CPP payments receivable (excluding child benefits) for said disability, payments made by the Workplace Safety and Insurance Board receivable for said disability and any other indemnity receivable referred to in the policies, would equal 75 percent of the weekly pay at the commencement of disability of the affected member. Benefits shall continue until the termination of disability, rehabilitation as provided by the policy, death of the recipient or the 60th birthday of the member, whichever shall first occur. 15.03 Members shall be entitled to sick leave credits of twelve (12) hours per month for each month of employment during which the member is not absent due to personal illness or accident for more than fifteen (15) consecutive days. Such credits may be accumulated to a maximum of eight hundred (800) hours. For members successfully completing twelve (12) months of employment without using a sick day will receive a bonus of five hundred (500) dollars to be paid on the first pay of February the following year. Upon termination with the Service, members will not receive compensation for sick time remaining in their banks. 15.04 If a member is disabled from performing the duties of his employment because of personal illness or accident, such member shall be entitled to payment from the employer no his regular paydays to the full amount of his...
Sick Leave and Disability Benefits. 18.01 All employees shall be entitled to leave from employment (with pay) while disabled from performing their duties because of personal illness or accident or medical appointments, subject to the limitations of this Article. Such sick leave credits may only be used by employees to cover wages the employees would have otherwise earned until eligible for the short-term disability benefits set out in this Agreement or such sick leave credits, lieu and vacation to top up their short- term disability to 100% of their normal wages. 18.02 On January 1st of each year, every seniority employee shall be provided with seven (7) days sick leave credits. Unused credits shall be paid out at the end of the calendar year in which granted unless the employee elects to retain these credits. Yearly credits may be accumulated to a maximum of thirty (30) days. At the completion of any calendar year or when an employee leaves the Employer’s employment for any reason aside from termination for just cause, the employee shall be entitled to a payout of these days.
Sick Leave and Disability Benefits. 19.01 Sick leave and disability benefits are provided when personal illness or injury prevents an employee from attending work. 19.02 Employees who have completed the probationary period shall be credited with 22.5 hours of sick leave and shall then accumulate sick leave at the rate of 7.5 hours for each period of 162.5 hours paid, to a maximum of 105 hours. Employees who are then absent because of personal illness or injury may use such earned credits, to the extent of the credits available, to continue wages for scheduled shifts lost during the first 14 consecutive calendar days of any period of sick leave or disability. 19.03 If absence continues, the employee shall apply for Employment Insurance sick leave benefits. ⮚ the first 14 consecutive calendar days of any period of sick leave or disability will be followed by four (4) weeks of weekly indemnity, at 66- 2/3% of the employee’s straight time wage; ⮚ then, fifteen (15) weeks of employment insurance, with a top up to 66- 2/3% of the employee’s straight time wage, would be provided; ⮚ then, thirteen (13) weeks of weekly indemnity at 66-2/3% of the employee’s straight time wage would be provided. If an employee does not qualify for Employment Insurance sick leave benefits because the employee has not worked sufficient insurable hours to qualify, she may apply for the benefits set out in part 19.04. Such benefits, whether used under this provision, or under the provisions of Article 19.04 are only available to the maximum set out in section 19.04. 19.04 The Employer will pay 100% of the premium for a weekly indemnity plan. The benefit will be available as of the first day of the 18th week of continuous absence, (or as set out in 19.03) and will continue for an additional 17 weeks. The payment will be sixty-six and two thirds percent (66-2/3%) of scheduled straight time wages lost. Payments will be mailed to an employee’s home, or deposited directly to their bank account. The weekly indemnity benefit is only available to an employee who has completed probation. Premium costs will prorate in accordance with the proration formula in this Collective Agreement. Weekly Indemnity participation is voluntary for all employees, but an employee who chooses not to participate is not eligible for the Employment Insurance “top-up”. Sick Leave and Disability Benefits. 23.01 All employees shall be entitled to leave from employment while disabled from performing the duties of employment because of illness and/or injury, subject to the limitation of this article. It is understood that the sick leave credits are for the illness and/or injury of the employee, however employees who require time off to care for their ill and/or injured immediate family member may use up to three (3) days per calendar year to be charged against the employee’s sick accrual. In the event more time is required to care for the immediate family member, the employee shall inform his/her immediate supervisor of the circumstances. 23.02 Employees shall be entitled to sick leave credits of one and one half (1½) days per month worked, which credits may be accumulated. However, no payment shall be made for accumulated credits on termination of employment. 23.03 Any employee deemed as being temporarily disabled from performing the duties of his or her employment as a result of a workplace injury and/or illness, shall be entitled to payment under WSIB, so long as the claim is approved, or by the short-term or long-term disability insurance plan defined by this Agreement. Subject to the provisions of Articles 24 and 26, the Employer agrees to make up the difference between WSIB and/ or any Group Disability Insurance coverage payments and the employee's net (take home) pay for any employee while absent due to such illness and/or injury using the individual's accumulated sick leave credits and in the event the employee's sick leave credits are exhausted, any outstanding vacation time shall be used. (a) An employee absent because of personal illness or accident, shall notify his or her immediate supervisor, in the case of office and non-shift personnel, not later than one-half (½) hour prior to the commencement of his or her working day and in the case of shift personnel, not later than one (1) hour prior to the commencement of his or her shift.
Sick Leave and Disability Benefits. 8-1 Nine (9) and ten (10) month employees shall be credited with fifteen (15) days of sick leave at the beginning of each school year. Twelve (12) month employees shall be credited with eighteen (18) days of sick leave at the beginning of each school year. One day of sick leave awarded will equal the number of hours the employee is contracted to work per day, regardless of the number of days per week they work. Sick leave will be deducted in hours corresponding to actual hours worked on a scheduled work day. Unused sick leave shall accumulate without limit. Employees who begin service later in the school year will be credited with a prorated number of days of sick leave for the balance of the school year on a basis of one and one-half (1 ½) days of sick leave for each school month of service to be performed during that year. Employees who leave the district prior to the end of the school year shall only be given their prorated share of sick leave predicated on a basis of one and one-half (1 ½) days per month worked.
