HOURS OF WORK - OVERTIME - HOLIDAYS. 1. Five consecutive eight hour days to be worked from Monday through Saturday, inclusive, shall constitute a work week. The scheduled hours of work shall be from 8:00 A.M. to 5:00 P.M. with one hour for lunch beginning not earlier than 11:00 A.M. and completed no later than 2:00 P.M. When the duties of a job require a regular scheduled working period varying from the foregoing, such schedule shall be mutually arranged by the parties hereto and shall not exceed eight hours a day or forty hours a week. 2. Employees assigned to work which regularly operates twenty-four hours a day, seven days a week, including Sundays and Holidays, shall be designated as "shift" employees. The hours for shift employees, covered hereunder, shall be from 8:00 A.M. to 4:00 P.M., 4:00 P.M. to Midnight, and Midnight to 8:00 A.M., and shall not exceed eight hours a day or forty hours a week. With the consent of the Supervisor, Shift Employees shall have the privilege of exchanging shifts within the same work week by individual arrangement, provided the change can be accomplished without additional costs to the Company. Management, at its discretion, may establish a work week consisting of four (4) ten (10) hour days for a particular work group. The days of the work week will be Monday through Saturday, not necessarily consecutive days. a. The management of each work group will determine/approve the available shifts which will include a 30 minute or 60 minute lunch period. b. Starting time will be no earlier than 6:00 a.m. and no later than 9:00 a.m. Schedules must remain constant once established but may be changed with management’s approval (taking needs of service and seniority into consideration). c. Individuals in a work group working four (4) ten (10) hour days who wish not to participate in the schedule will continue with, or return to a five (5) day work week d. The applicable overtime rate will be paid for all overtime outside of the mutually agreed upon work hours. e. Sick time and vacation time will be charged in ten (10) hour increments (eight (8) hours sick waiting is not changed). f. A holiday, jury duty and funeral leave that falls during the agreed upon work week will be paid in 10 hour increments g. When a holiday falls outside of the mutually agreed work week, an additional eight (8) hours of holiday pay will be paid for a total of 48 hours pay. h. HOURS OF WORK - OVERTIME - HOLIDAYS. 1. HOURS OF WORK - OVERTIME - HOLIDAYS. Section 1. 255 "Overtime Pay" is the amount to be paid to an employee in excess of that earned at his regular hourly rate for work performed in excess of eight (8) hours in any workday. 256 "Premium Pay" is the amount to be paid to an employee in excess of that earned at his regular hourly rate for work performed on the employee's first off-duty day, second off- duty day, on a holiday as designated in this Article and on a Sunday which is included within the employee's regular five- day schedule of work on continuous operations. 257 "Regular Rate of Pay" of an employee shall be determined by dividing his total straight time earnings for time worked including the additional 6% night shift bonus as calculated under Section 4 (c) of this Article paid for second and third shifts worked, but excluding all premium and overtime pay during the workweek, by the total hours worked during the workweek. 258 "Employee Workweek" means a period of seven (7) consecutive twenty-four (24) hour days commencing with the scheduled starting time of the regular first shift on Monday provided, however, at a Company operation where the regularly scheduled third shift begins on Sunday evening, the "Employee Workweek" shall commence with the regularly scheduled starting time of the third shift on Sunday and provided that for employees whose regular job assignments commence daily prior to the starting time of the regular first shift or third shift on Sunday or Monday as applicable, such employee's workweek shall commence at the regular starting time of their job assignments. 259 "Work Day" for the purpose only of determining whether an employee has worked in excess of eight (8) hours in a day, shall mean a period of twenty-four (24) consecutive hours from the time an employee begins the shift in which the work is performed. 260 "Day" for the purpose only of determining off-duty days, designated holidays and Sunday as used in this Article shall mean a period of twenty-four (24) consecutive hours commencing at the same hour each day as the beginning time of the employee's workweek. 261 "First Off-Duty Day" for an employee on non-continuous operations is the sixth day in his workweek. 262 "First Off-Duty Day, Continuous Operations" for an employee shall be his first scheduled day of rest in the workweek. 263 "Second Off-Duty Day" for an employee on non- continuous operations is the seventh day in his workweek. 264 "Second Off-Duty Day, Continuous Operations" for an employee shall be his...

Section 2. Shifts and day schedules may be changed in emergencies or for specific projects. Section 3. Employees who are called to work after having completed their work shift or on their scheduled days off shall be compensated at the rate of one and one-half (1 1/2) times their regular rate of pay or 1 ½ non-exempt compensatory time. Compensation shall be for no less than two (2) hours for each callout. It is understood that this provision does not apply to work which is a continuation of the workday or when the employee decides to return to work at a later time rather than continue the workday. Section 4. All hours worked over eight (8) hours in a workday or over forty (40) hours in a work week will be compensated for at the rate of one and one-half (1 1/2) times their regular hourly wage or 1 ½ non-exempt compensatory time. Any overtime worked must first be approved by management. There shall be no pyramiding of overtime. The alternate work schedule is defined as four (4) consecutive workdays, each workday consisting of ten (10) hours between 7:00 a.m. and 5:30 p.m. with one half-hour (1/2) hour unpaid lunch break. The alternate work schedule week shall consist of forty (40) hours; that is, four (4) workdays. Which days are worked and which are taken off are determined by seniority. Eight (8) hours shall constitute a days work from eight (8:00) a.m. to twelve (12:00) noon and from twelve-thirty (12:30) to four-thirty (4:30) p.m. on Monday, Tuesday, Wednesday, Thursday, and Friday. The last five (5) minutes before the accepted lunch period and five (5) minutes prior to the end of a shift shall be allowed the employee for personal clean up. C. An employee who misses a day of work Monday through Friday shall be allowed to work on Saturday at straight time wages as a make up day. This make up day is on a voluntary basis and no employee shall be compelled to work under this provision against their wishes. Section 2. Holidays observed by this Agreement are: New Year’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, Day after Thanksgiving Day and Christmas Day.   • HOURS OF WORK AND OVERTIME 14.01 This Article only provides the basis for the calculation of time worked and shall not be construed as a guarantee of the hours of work in a day or a week or a guarantee of days of work or otherwise. 14.02 The Employer may schedule hours of work to meet its operational needs and these may vary from employee to employee. The Employer shall endeavor to create/schedule as many forty (40) hour/week positions as possible. For clarity, Part-Time employees shall not be assigned hours of work that could otherwise be performed by an employee with less than forty (40) hours per week without the FT employee’s consent. Consistent with same, Part-Time employees shall be capped at twenty-four (24) hours/week with any/all additional hours of work being offered by seniority to those Full-Time employees with less than forty (40) hours/week prior to being offered/assigned to Part-Time positions. The above does not apply in situations where an employee has left during his/her shift for medical/personal emergency situations in which case the PT employee may be assigned to replace the absent employee for the duration of the shift. In the interest of full transparency, a composite Master Work Schedule for all employees in each respective location shall be posted in each store/work location at least one week prior to said monthly schedule taking affect. At the Union’s request, the composite Master Work Schedule and any revisions to same shall be forwarded within twenty-four (24) hours to the SEIU Local 2 Union Office via fax (000) 000-0000 or by e-mail to xxxx@xxxxxxxxx0.xx. 14.03 There shall be two (2) fifteen-minute rest periods during eight (8) hour shift each shift and a thirty (30) minute lunch period. Save for express authorization, all breaks and meals are mandatory with the exception of clerks working alone. For every four consecutive hours a clerk that works alone he/she shall be paid an additional fifteen (15) minutes of straight pay to compensate for the loss of the break time. 14.04 Overtime shall be paid at the rate of time and one-half for all hours worked in excess of eight (8) hours in one day or in excess of forty (40) hours in any one week. Overtime shall not be mandatory unless the Employer requires it to properly staff its facilities in which case the employee(s) with the least seniority in the classification shall be required to work. 14.05 Overtime will be divided as evenly as practicable amongst those employees normally performing the work within the classification in which the overtime is required. Every reasonable effort will be made to even out the hours amongst the forementioned employees during the life of this agreement. 14.06 There shall be a five (5) minute wash-up period before lunch and at the end of the shift. 14.07 All employees will be paid on Thursday of each week. 14.08 All work performed including money-related duties such as banking transactions, counting of float, totaling of dally receipts, etc. shall be conducted during working hours. 14.09 The Employer agrees not to create split shifts. 14.10 In the event of an error by the Employer on an employee's pay that results in an overpayment, the Employer shall discuss with the Employee a repayment plan that Is reasonable and feasible in mutual agreement with the Employee. If an employee leaves the employ of the Society of Saint Xxxxxxx xx Xxxx before the repayment is completed the Employer shall deduct the remaining amount in full from the employee's final pay.

  • HOURS OF WORK i) Where employees are now working a longer daily tour, the provisions set out in this Article governing the regular hours of work on a daily tour shall be adjusted accordingly. ii) The normal daily extended tour shall be 11.25 consecutive hours in any 24-hour period, exclusive of a total of forty-five (45) minutes of unpaid meal time. For hybrid schedules, there will be scheduled normal daily tours of seven and one-half (7½) hours and 11.25 consecutive hours per day. iii) Employees working an extended tour shall be entitled, subject to the exigencies of resident care, to paid relief periods during the tour of a total of forty-five (45) minutes. For hybrid schedules, there will also be shifts that provide for relief periods in accordance with Article 15.02. iv) Scheduling issues will be resolved at the local level. v) Where the union and the employer have agreed to or agree to an extended daily tour or hybrid schedule that differs from the normal daily extended tour, the proportion of unpaid time to hours of work shall maintain the same ratio as set out in paragraph ii) and iii) of this Article.
